ABOUT CUSTOMS SERVICE

This Law determines legal basis, principles of activity, tasks, rights and obligations of the customs service.

PART I. GENERAL PROVISIONS

Article 1. State Customs Service of Turkmenistan

The State Customs Service of Turkmenistan is a state governing body that implements state policy in the field of regulating the activities of the customs system of Turkmenistan, ensures compliance with Turkmenistan's international obligations on customs issues, and also fights against smuggling and other crimes, administrative offenses in the field of its activities.

Article 2. Legislation of Turkmenistan on the customs service

1. The legislation of Turkmenistan on the customs service is based on the Constitution of Turkmenistan and consists of the Customs Code of Turkmenistan, this Law, as well as other normative legal acts of Turkmenistan regulating the activities of the customs service.

2. If an international treaty of Turkmenistan establishes other rules than those provided for in this Law, then the rules of the international treaty shall apply.

Article 3. Composition and leadership of the State Customs Service of Turkmenistan

1. The structure of the State Customs Service of Turkmenistan includes its central office, the Training Center under the State Customs Service, customs in the velayats and cities with the rights of the velayat, their customs posts on the territory of Turkmenistan and checkpoints on the State border of Turkmenistan, other bodies of the customs service ( hereinafter referred to as the customs authorities).

2. The leadership of the State Customs Service of Turkmenistan is carried out by the chairman, who is appointed to and dismissed by the President of Turkmenistan.

Article 4 Legal status customs service

Article 5. Basic principles of the activities of the customs service

Article 6. Main tasks of the customs service

13) performance of other tasks defined by the legislation of Turkmenistan.

Article 7. Observance of the rights and freedoms of citizens

Citizens detained on suspicion of violating customs rules have the right to receive information from customs officials about the restriction of their rights and freedoms.

Article 8. Location of customs authorities

1. Customs authorities may be located in buildings directly owned by customs authorities, as well as in territories and buildings owned by interested persons, including territories owned by persons engaged in customs intermediary activities or having special warehouses for temporary storage of goods, as well as in territories and buildings of airports, river and sea ports, railway and automobile stations.

2. Land plots are provided to the customs authorities for use in accordance with the Code of Turkmenistan "On Land".

Article 9

Activities for the customs inspection of goods and vehicles and their clearance are carried out directly at the location of the customs authorities or, at the request of persons, with the permission of the customs authorities, in other places. Article 10. Procedure for the work of customs authorities

1. The order of work and working hours of the customs authorities are established in accordance with the legislation of Turkmenistan by the head of the customs service.

2. Article 11. Interaction of the customs service with law enforcement and military authorities of Turkmenistan

Article 15. Activities performed by the customs service

1) participates in the development of the state customs policy of Turkmenistan and its implementation;

2) within its competence, participates in ensuring the economic security and economic independence of Turkmenistan, as well as the interests of the state in this direction;

3) exercise control over compliance with the legislation of Turkmenistan on customs;

4) ensures control over compliance with the procedure established by the legislation of Turkmenistan related to the passage of goods and vehicles in transit through the customs border of Turkmenistan;

5) uses the resources of regulation of trade and economic activity, proceeding from the interests of the customs business, participates in the development of measures related to economic policy in the field of transit passage of goods across the customs border;

Article 16. Rights of the customs service

The customs service has the right:

1) in agreement with the President of Turkmenistan to create customs and in their structure customs laboratories, cynological centers;

3) to submit a requirement to persons to confirm the eligibility of performing functions related to customs activities, verification of documents proving their identity from citizens and officials;

4) to conduct customs checks, unhindered entry into buildings, warehouses and territories adjacent to them, regardless of the form of ownership, on which goods subject to customs examination are stored, receiving required documents and sealing of such buildings and warehouses;

5) to carry out activities related to the functioning of customs warehouses and warehouses for temporary storage of goods;

6) to submit a demand within its competence to eliminate violations of customs legislation to the heads of legal entities, regardless of the form of ownership, officials, private entrepreneurs and individuals;

7) to detain and deliver to the office buildings of the customs and law enforcement agencies, as well as health care institutions of Turkmenistan, persons who violated customs rules, committed criminal acts or are suspected of committing such acts;

Article 17. Duties of the customs service

The customs service is obliged:

1) in accordance with the legislation of Turkmenistan, develop regulatory legal acts in the field of customs activities, ensure their adoption in the prescribed manner and their implementation;

2) carry out customs control and customs clearance;

3) approve and implement samples of official documents and forms required for customs control and customs clearance;

4) determine the places of temporary storage of goods and vehicles subject to customs inspection, and, if necessary, accompany them;

5) determine the conditional (code) designations of goods crossing the customs border of Turkmenistan or intended for transportation under the commodity list of foreign economic activity (CFEA) and make preliminary decisions on these issues and the countries of origin of goods;

6) take measures to improve material support and social protection customs officials;

7) conduct an inquiry into the facts of smuggling and evasion of payment of customs fees and duties;

8) perform other duties assigned to it by the legislation of Turkmenistan.

PART III. PROCEDURE OF SERVICE IN THE CUSTOMS SERVICE

Article 18. Personnel composition of the customs service

1. Military personnel, as well as employees who are not in military service (hereinafter referred to as employees), form staffing customs service.

2. Appointment to the post of military personnel of the customs service, their transfer to other positions and dismissal, assignment of military ranks to them and deprivation of military ranks are carried out in the manner established by the Law of Turkmenistan "On military duty and military service" and other normative legal acts of Turkmenistan.

3. Customs servicemen are subject to the benefits and benefits provided for by the Law of Turkmenistan "On the status and social protection of military personnel and members of their families" and other regulatory legal acts of Turkmenistan.

4. Labor Relations customs officers who are not in military service are regulated by the labor legislation of Turkmenistan.

Article 19

1. Citizens of Turkmenistan who speak the state language of Turkmenistan, who have served the established terms of military service by conscription, are able to perform the tasks assigned to the customs service in their diligence, personal traits, moral qualities, physical fitness, educational level and health, living in Turkmenistan, are accepted on a voluntary basis for military service in the customs authorities.

2. Citizens accepted for service in the customs service must meet the following requirements:

1) loyalty to Turkmenistan, its people and the President of Turkmenistan;

2) irreproachable observance of the requirements of the Constitution of Turkmenistan, laws and other normative legal acts of Turkmenistan;

3) respect and protection of the rights and freedoms of citizens, their legitimate interests, observance of a high level of culture;

4) protection of the independence of the state, its political and economic interests;

5) respect for national traditions and customs of the people of Turkmenistan;

6) observance of a high level of discipline and responsibility;

7) creative approach to business, the ability to carry out their activities in accordance with the legislation of Turkmenistan;

8) tactful character, honesty, the ability to objectively and critically evaluate the results of their work.

3. Citizens employed by the customs service submit documents and information in accordance with the legislation of Turkmenistan.

Article 20. Service time and the right to rest of employees of the customs service

1. The procedure for recording the duration of working hours and rest time of customs officers is established in accordance with the legislation of Turkmenistan.

2. Customs officers in accordance with the Law of Turkmenistan "On the status and social protection of military personnel and members of their families" and Labor Code Turkmenistan is granted annual basic leave and other types of leave.

Article 21

1. Monetary security of customs officers consists of monthly official salaries employees, additional payments for military ranks and other types of payments provided for by the legislation of Turkmenistan.

2. PART IV. USE OF PHYSICAL MEASURES, SPECIAL FORCES AND EQUIPMENT AND FIRE-ARMS (SERVICE) WEAPON BY CUSTOMS SERVICE EMPLOYEES

Article 22

1. Customs officers are granted the right to use physical force, special forces and means and carry, store, use firearms (service) weapons only in cases and in the manner prescribed by this Law and other regulatory legal acts of Turkmenistan.

2. The use of physical force, special forces and means and firearms (service) weapons in excess official powers and the limits of necessary defense entails responsibility under the legislation of Turkmenistan.

Article 23. Use of physical force

Customs officers have the right to use physical force, including hand-to-hand combat techniques, if the measures taken by them obviously do not ensure the fulfillment of the emerging tasks of preventing and suppressing smuggling and other dangerous violations of customs rules, detaining the persons who committed them, and eliminating opposition to their legal requirements .

Article 24. Use of special forces and means

1. Customs officers have the right to use handcuffs, rubber truncheons, devices for the forced stop of transport, service dogs, as well as other special forces and vehicles in the following cases:

1) when repulsing an attack on customs officers and other persons in the performance of official or public duties to combat smuggling;

2) when repulsing an attack on buildings, houses, structures, vehicles of customs authorities;

3) when detaining violators of customs rules who do not obey customs officers or who resist them;

4) if there are good reasons to suspect the escorted detainees of the intention to escape or harm others or themselves, for the escort of the detainees and their protection;

2. It is prohibited to use special forces and means against women with obvious signs of pregnancy, minors and people with obvious signs of disability, except in cases of attacks that threaten people's lives, group attacks or armed resistance.

3. The list of special forces and means used by customs officers and the procedure for their use are determined by the Cabinet of Ministers of Turkmenistan.

Article 25. Storage, carrying and use of firearms (service) weapons

1. Customs officers in the performance of their duties have the right to store, carry and use firearms (service) weapons.

2. Customs officers have the right to use firearms (service) weapons as an exceptional measure only in the following cases:

1) if it is impossible to protect people in other ways or means - to protect them from an attack that threatens their life and health;

2) in the performance of official duties by customs officers to combat smuggling and other crimes - to repel armed and other attacks that pose a threat to their life and health;

3) to repel armed attacks on objects, buildings and houses protected by the customs service;

4) to detain a person providing armed resistance, as well as a person who refuses to obey legal demands to surrender weapons, to detain an armed person, if the methods and means used do not allow to effectively repel resistance, detain or disarm him;

5) if a person driving a vehicle, not obeying the lawful demands of a customs officer to stop, poses a threat to the life and health of people, in the absence of other possibilities for his detention.

3. The use of firearms (service) weapons must be preceded by a warning about the intention to use them.

4. Firearms (service) weapons may be used without warning in the following cases:

1) in case of a sudden armed attack using military equipment, vehicles, aircraft, sea and river vessels;

2) when armed persons who have committed smuggling and other crimes escape with the use of vehicles.

5. In all cases of the use of firearms (service) weapons, a customs officer is obliged to take all possible measures necessary to ensure the safety of the people around, and, if necessary, to provide emergency assistance to the victims.

6. It is not allowed to use firearms (service) weapons against women with obvious signs of pregnancy, minors and persons with obvious signs of disability, with the exception of cases when they commit an armed attack that threatens the life of an employee, provides armed resistance, seizes vehicles using weapons or group attack and in other cases, if it was impossible to repel such an attack by using other methods, forces and means.

7. On each case of the use of firearms (service) weapons, a customs officer must immediately inform his head and bring to the attention of the prosecutor exercising supervision.

Article 26

The use of special forces and means and firearms (service) weapons is permitted only to customs officers who have undergone special training.

PART V. LEGAL STATUS AND SOCIAL PROTECTION OF CUSTOMS OFFICIALS

Article 27 Legal status customs officers

1. Customs officers in the performance of their official duties are representatives state power and are under state protection. The lawful demands of customs officers are subject to mandatory execution by all physical and legal entities as well as officials.

2. Failure to comply with the legal requirements of customs officers, insulting their dignity, resisting them, discrediting them, threatening them with violence or an attempt on their life, health, honor and dignity, or slander, other actions that impede the fulfillment of the tasks assigned to them, as well as any attempts in connection with the performance of their duties on their close relatives and family members entail liability established by the legislation of Turkmenistan.

3. Employees of the customs service in the performance of the tasks assigned to them are guided by this Law and other normative legal acts of Turkmenistan regulating customs activities. Except for persons authorized by the legislation of Turkmenistan, no one has the right to interfere in the affairs of the customs service, to involve customs officers in the performance of tasks not assigned to them.

4. Any actions on the part of public authorities and administration, public associations and the media, their representatives, as well as officials who have the goal of influencing decisions made by the customs service and interfering in its activities, entail liability established by the legislation of Turkmenistan.

5. Customs officers are prohibited from engaging in any other paid activity, except for teaching, scientific and creative work.

Article 28. Social protection of customs officers

1. Social protection of customs officers is guaranteed by the state.

2. State insurance of customs officers related to the performance of official duties is carried out in accordance with the procedure established by the Law of Turkmenistan "On the status and social protection of military personnel and members of their families" and the Labor Code of Turkmenistan.

3. Damage caused to a customs officer in the performance of his official duties, and damage caused to his property, members of his family in connection with the performance of official duties, shall be compensated in the manner prescribed by the legislation of Turkmenistan.

4. Employees of the customs service, in the manner prescribed by the legislation of Turkmenistan, are provided with office living space.

5. Employees who have worked in the customs service for at least ten years, members of the families of deceased employees, as well as in other cases established by the housing legislation of Turkmenistan, are not subject to eviction from the official living space without providing another living space.

6. For the family deceased employee, who was registered to improve housing conditions, in accordance with the legislation of Turkmenistan, the right to improve housing conditions is retained.

7. Customs officers and members of their families enjoy other rights and benefits established by the Law of Turkmenistan "On the status and social protection of military personnel and members of their families" and the Labor Code of Turkmenistan.

Article 29. Other types of guarantees social rights customs officers

Customs officers and members of their families, in the manner and under the conditions established by the Cabinet of Ministers of Turkmenistan, enjoy benefits for paying for housing, social services and fuel.

Article 30. Rights of customs officers during a business trip

PART VI. FINANCIAL AND LOGISTIC SUPPORT OF THE CUSTOMS SERVICE

Article 31. Financing the activities of the customs service

1. Financing of the activities of the customs service is carried out in accordance with the established procedure, at the expense of the State budget of Turkmenistan.

2. Improving the activities and strengthening the material and technical base of the customs service can be financed from the State budget of Turkmenistan, non-budgetary funds of the customs service and funds received from other sources not prohibited by the legislation of Turkmenistan.

3. The customs service, in accordance with the procedure established by the legislation of Turkmenistan, carries out its financial and economic activities, conducts Accounting and statistical reporting.

Article 32. Material and technical support of the customs service

1. Provision of the customs service with material and technical means and their management are carried out in accordance with the legislation of Turkmenistan.

2. PART VII. FINAL PROVISIONS

Article 33. Appeal against decisions of the customs service and their employees

Decisions of the customs service and their employees can be appealed in the manner prescribed by the legislation of Turkmenistan.

Article 34. Control over the activities of the customs service

Control over the activities of the customs service is carried out by the Cabinet of Ministers of Turkmenistan in the manner determined by the President of Turkmenistan.

Article 35. Supervision over compliance with the law by the customs service

Supervision over the exact and uniform execution of laws by the customs service of Turkmenistan is carried out in accordance with the legislation of Turkmenistan by the Prosecutor General of Turkmenistan and prosecutors subordinate to him.

Article 36. Responsibility of employees of the customs service

Customs officers, within their competence, are responsible for ensuring legal norms, protecting the rights of citizens and the legitimate interests of the state. Customs officers, depending on the nature and severity of the offenses committed by them, are subject to disciplinary, material, administrative or criminal liability.

Article 37. Entry into force of this Law

This Law shall enter into force on the day of its official publication.

Customs regulations for passengers

Commercial imports are always taxed.

If the quantity or nature of the goods suggests that they may be used for commercial purposes, customs duties and other taxes must be paid on them. This also applies to any other goods imported for profit.

Importation is not considered commercial if the goods are imported by an individual in accompanied baggage for personal or family purposes or as gifts

Mandatory declaration.

Goods whose importation is restricted or taxed customs duties, excises, or other payments are subject to mandatory declaration in writing. Goods not intended for industrial or commercial purposes are declared by individuals in a simplified manner, without filling out a passenger customs declaration.

The purpose of the goods is determined by the customs authority based on the statement of an individual about the goods transported across the customs border of Turkmenistan, taking into account the following:

  • the nature of goods and their quantity
  • frequency of movement of goods

Declaration of goods.

The declaration must be completed by those individuals who have reached the age of majority.

Goods belonging to persons who have not reached the age of majority must be declared by their parents, adoptive parents, guardians, guardians or other individuals acting on behalf of these persons.

Rules for the import and export of foreign currency from Turkmenistan by individuals.

Individuals can bring foreign currency in cash into Turkmenistan without any restrictions, but having declared them at the customs authorities. Individuals can export from Turkmenistan their foreign currency in the amount of not more than 10,000 US dollars or its equivalent in another currency, as well as foreign currency that was previously imported in cash and declared to the customs authorities of Turkmenistan, upon presentation of a customs declaration confirming the right to import.

Import of goods without payment of customs duties and taxes.

Goods imported by individuals in hand luggage through the customs border of Turkmenistan, the total weight of which does not exceed 60 kg, including 1 kg. jewelry are exempt from customs duties.

For every 1 kg. exceeding the allowable 60 kg. US$10 customs duty is charged.

For every 1 gr. jewelry exceeding the allowable 1 kg. US$0.20 customs duty is charged.

An individual may import for personal use without paying excise duty:

  • alcoholic drinks in the amount of 1.5 liters
  • tobacco products in the amount of 2 packs

Choose the right corridor!

In order to enable individuals to declare their belongings in a simplified manner and quickly, the Green Corridor and Red Corridor checkpoint systems are equipped at the customs border crossing points.

Choose the red corridor if you have goods subject to customs declaration or a mandatory declaration of their presence.

The green corridor system is used by individuals to verbally declare their belongings to the customs authorities, thereby declaring that the goods are subject to.

Rules for the importation of domestic animals and plants.

Customs clearance of domestic animals and plants subject to veterinary and phytosanitary control can be completed only after agreement with the relevant authorized state bodies exercising such control.

Import and export of fuel.

The fuel of the factory standard gas tank of a motor vehicle traveling to Turkmenistan or beyond its borders is not subject to customs payments.

Import of medicines.

The passenger can bring with him medicines purchased according to a prescription, intended for self-treatment. The passenger must justify that the medicines are intended for his treatment. The importation of medicines purchased by prescription is carried out by presenting a prescription. Subject to the above conditions, the import of medicines is not subject to declaration.

Importation of the following goods and their exportation from customs territory prohibited in accordance with the law and international agreements, based on the protection of national security, public order, morality, life and health of people, property rights, as well as objects of intellectual property rights, flora and fauna, artistic, historical and archaeological resources of people, as well as taking into account other interests of Turkmenistan:

  • all types, types and models of weapons by citizens in order to ensure personal security(including gas cartridges, stun guns, brass knuckles, brushes, etc.)

Temporary storage of seized goods.

Rules for the temporary importation of goods and items by individuals across the customs border of Turkmenistan and their re-export.

Persons who bring goods into Turkmenistan on the condition that they will be exported back (for example: cameras, cameras, laptops, professional technical equipment for the media, etc.) must be declared when they are imported to the customs border of Turkmenistan and exported back upon presentation of a customs declaration confirming the import.

Vehicles and their trailers (semi-trailers) belonging to the 8703 commodity group Commodity Nomenclature Foreign Economic Activity that are permanently registered in foreign states are allowed to be imported into the customs territory of Turkmenistan by foreign citizens and stateless persons for a period established by the customs authorities based on the relevant confirmations extended by the customs authorities for such a period as provided in the visa.

Such vehicles are issued at the border by the customs authorities of Turkmenistan when filling out the obligation to re-export in two (2) copies. The first copy remains in the customs authority, and the second copy is issued to the owner of the vehicle, which is the basis for the re-exportation of the vehicle from the customs territory of Turkmenistan.

Vehicles temporarily imported by foreign citizens and stateless persons into the territory of Turkmenistan with the obligation to re-export are subject to mandatory export from the customs territory of Turkmenistan at the end of the established period and cannot be alienated in the territory of Turkmenistan.

Inspection of goods.

When traveling by bus or by car, the passenger should pass with his luggage through the screening room, if the baggage screening is not carried out in vehicle. According to the rules, the inspected passenger is obliged to disassemble his luggage for inspection himself, as well as pack the baggage again after inspection. The passenger is obliged, at the request of the customs officer, to provide his personal data.

A passenger who is in charge of baggage or imported goods belonging to another person should pass through the screening room together with the owner of the goods in order to avoid payment obligations and other consequences arising from the possible excess of the permitted volumes of imported goods.

The main document regulating the activities of the Service is the Customs Code, which entered into force on January 1, 2011. The Code defines the principles of state regulation of the customs business, contributes to the observance of the interests of our country. As part of the civil service, there are six customs departments located in all velayats and the capital. In the context of the successful implementation of the national strategy for the integrated development of the transport and logistics sector, the formation of a modern information and communication system, the requirements for the level of professional training of customs officers have increased. The Military Institute of the Ministry of Defense annually graduates 25 highly qualified specialists - officers who have been trained at the Faculty of Customs. The Training Center at the Service operates training courses for recruits and professional retraining for military personnel in various areas, - says the head of the Training Center, Captain Suleiman Orazov. - The training program includes thematic lectures, language training, political studies, as well as training sessions on working with customs equipment. Turkmenistan has been a member of the World Customs Organization (WCO) since 1993 and, within its competence, cooperates with international organizations such as the OSCE and UNDP.
