A unified licensing mechanism in the field of foreign trade in goods was introduced on the territory of the Russian Federation in November 1992. In Russia, the practice of licensing became widespread in the 1990s. in connection with the creation of institutions of special exporters and companies (for example, banks) authorized to conduct foreign economic activity. The list of goods, operations with which require licensing, includes, first of all, quota products intended for export, as well as some specific groups, such as: resources and strategic goods, medicines, children's assortment etc.

The main objectives of licensing in the countries of the Customs Union are:

Export regulation material resources, protection domestic market from uncontrolled export of raw materials;

- restrictions on the import of certain types of goods into the Russian Federation.

Licensing in the field of foreign trade in goods is established in the following cases:

The introduction of temporary quantitative restrictions on the export / import of certain types of goods (after the distribution of the quota, the winner is issued a document on the basis of which he can issue a license, that is, all quota goods are moved through customs border Customs Union under licenses);

- implementation of the licensing procedure for the export / import of certain types of goods that may have an adverse impact on the security of the state, state and municipal property, environment, life, health of animals and plants;

- granting the exclusive right to export / import certain types of goods;

- fulfillment by the Russian Federation of international obligations.

The basis for the export / import of certain types of goods, in the cases listed above, is an export (import) license. The absence of a license is the basis for refusal to release goods by the customs authority of the Customs Union.

The licensing procedure applies to all participants in foreign economic activity, regardless of the form of ownership, place of registration, market position. The license is issued for one type of goods, in accordance with its TNVED code of the Customs Union, regardless of the number of items of goods included in the contract.

The following types of licenses are issued in the Russian Federation:

One-time license (for one contract) - a license issued by a participant in foreign economic activity, on the basis of foreign trade deal(on the basis of one contract), the subject of which is a licensed product, granting the right to export / import this product in a certain amount, with a buyer (seller) specified in the contract. The period of validity of a one-time license cannot exceed one year from the date of commencement of its validity. The validity period of a one-time license may be limited by the validity period of a foreign trade contract (agreement) or by the validity period of a document that is the basis for issuing a license. For goods subject to quantitative restrictions, the license expires in the calendar year for which the quota is set.

General license - a license issued to a participant in foreign trade activities on the basis of a decision of a party (the government of the Russian Federation), representing the right to export / import separate species licensed goods, in a certain quantity, without identifying a specific seller (buyer of goods). The term of a general license cannot exceed one year from the date of commencement of its validity, and for goods subject to quantitative restrictions, it ends in the calendar year for which the quota is set, unless otherwise stipulated by the Decision of the Commission of the Customs Union.

Exclusive license - a license granting the right to export/ import of a separate type of goods. The term of validity of an exclusive license is established by the decision of the Commission of the Customs Union in each specific case. Issuance of general and exclusive licenses is carried out in cases stipulated by the Decision of the Commission of the Customs Union.

2010 was the beginning of the Customs Union, concluded between the leading countries of the former USSR, Russia, Belarus and Kazakhstan. Upon the entry into force of the agreement, the Unified List of Goods, which must be subject to licensing when imported into the entire territory of the Customs Union or exported from the territory of the Customs Union, acquired liquidity. The issuance of these licenses has become the prerogative of the competent authorities of the member countries of the Customs Union. In the Russian Federation, this body is the Ministry of Industry and Trade of the Russian Federation (Minpromtorg).

In connection with .

Types of licenses (single, general, exclusive)

  • A one-time license of the Ministry of Industry and Trade is issued for a certain batch of a specific product, it clearly reflects the seller, buyer, quantity and cost. A one-time license does not mean that it can be used once (one-time ≠ one-time). During the term of the license ( maximum term validity 1 year) there can be as many deliveries as you like, provided that the total quantity of goods delivered does not exceed the quantity specified in the license. Our company is engaged in registration of exclusively one-time import licenses of the Ministry of Industry and Trade.
  • A general license is issued for a certain batch of a specific product without specifying the contract number and data of the foreign counterparty (seller). This gives the Applicant the opportunity to make deliveries under different contracts concluded with different partners during the period of the license. However, in order to obtain such a license, it is necessary to have, among other things, a relevant government decree. Such licenses are issued very rarely.
  • An exclusive license of the Ministry of Industry and Trade for the import or export of a specific product is issued without specifying all other characteristics, including quantity and cost. This type of license gives the Applicant the widest range of powers. To obtain such a license, you must have the appropriate federal law. Such licenses are extremely rare.

The need for registration and validity of a license

The need to obtain a license can be clarified by referring to the 30th Decision of the Board of the Eurasian Economic Commission of 04/21/2015. For example, in the case of the import of RES or VChU, we are interested in and.
If the declared radio-electronic means or high-frequency device is not in the exceptions, then it is necessary to issue an import license. The license is valid for 1 year, but within the framework of those documents on the basis of which it will be issued (contract, specification, etc.). Only 1 TN VED code can be indicated in the license (in the case of a license issued by the Ministry of Industry and Trade for precursors and the precursor is part of another product, the main column indicates the TN VED code of the precursor, and in additional information about the product, its TN VED code). After the document is issued, it must be registered in customs Department and only after that the license can be used when importing / exporting goods.
