During the June 2017 hotline, in response to a teacher's question about her extremely low salary, you and said: "We have teachers' money andthe school itself decides the level of wages, it determines staffing and salary supplements...Indeed, this is the law now. Moreover, not only the school manages the salary level of employees, but any budgetary institution - a hospital, university, museum, theater, club, etc. In practice, this has led to the complete independence of the management of these institutions and is the main reason for the poverty of citizens - the screaming problem of the Russian economy.

In your reply to the teacher you speak of the so-called new system wages (NSOT), which began to be introduced in the public sector since 2008. It was the NSOT that allowed each school to "determine salary supplements," and it was the NSOT that was the fundamental cause of the income stratification and injustice that tens of millions of our countrymen regularly face. According to the NSOT, the salary is divided into "salary", "compensatory" and "incentive" parts. At the same time, since the ratio of these parts is advisory (not mandatory) in nature, salaries of about 2 thousand rubles are now in effect in some places.

Each administration in its place invents new ways of "savings". Now they have thought of transferring state employees to a part-time job while maintaining the same amount of work. Such a practice operates, for example, at MEPhI, as Anita Soboleva, Member of the Council under the President of the Russian Federation for the Development of Civil Society and Human Rights, spoke about (see speech from 7 minutes 05 seconds). In the video article “Snickering” public utilities cannot get even two thousand for their work, ”it is recorded that in the spring of 2017, employees of a budgetary organization are offered a monthly salary of 2-5 thousand rubles.

One can only wonder why none of the politicians will make the abolition of the NSOT the main point of their program. So much is said about corruption, poverty, crisis, and so on. But no one names the main reason for the progressive poverty of Russians and the general reduction of hospitals, schools, social services etc. So far, according to the law, all “saved” budget money can be converted into stimulating salary payments, this process cannot be stopped. NSOT is not beneficial to anyone, except for middle and lower managers, who are now receiving salaries that they could never even dream of.

When people get lost in the forest, they forget about their differences in views on poetry and heavy metal, even on the Crimea and Donbass: they join forces to survive. The combination of the NSOT and the law, which leaves all allocated money to a budgetary institution, has created a legal mechanism for transferring “saved” budget money into the pockets of those whom the leader deems it necessary to pay. Alas, while the entire political and government elite of Russia does not see the problem, and the New wage system continues to destroy the lives of millions of Russian citizens. In April, a petition was published on Change.org addressed to the Minister of Education, Olga Vasilyeva. Posted by Irina Kantorovich, Candidate of Historical Sciences. She writes that "now the budgets of universities, schools, regions have actually been turned into "feeding" for administrations." Kantorovich gives an example from MEPhI, where teachers found out that while they receive hardly 20,000 rubles, the salary of members of the university administration reaches two million. This situation is the rule, not the exception, the author of the petition emphasizes.

How is that, you ask. And it's very simple. In 2008, the salaries of state employees began to accrue in an innovative way- according to the rules of the NSOT, or the New System of Remuneration in State Institutions. How the NSOT works, Irina Kantorovich popularly explains here:

In short: the administration of the university (school, hospital) itself determines the regulation on remuneration. Formally, this is done by the collective, for some reason unanimously voting for the proposal of the authorities. The administration provides for a stimulating part in the salary fund - this is any money saved by a miracle or cunning from state financing. The administration itself decides who will receive this incentive part in the form of bonuses. The size of this part is unlimited - how much you save, how much you can spend.

“In practice, stimulating the lion's share is transferred to the salaries of the administration and persons close to it,” Kantorovich said in the petition. She demanded to abolish the NSOT in general, and to introduce a single tariff scale, according to which the salary of the chief cannot exceed the salary of a specialist by more than one and a half times. The petition was signed by more than 50 thousand people.

And then, finally, Kantorovich received an answer from the ministry.

Everything according to the law

“In fact, there is simply no answer,” Kantorovich states in an interview with Novye Izvestia.

But what is there anyway? There is a long explanation of how the payroll system works (there is no evaluation of the effectiveness of this work). There is a clause “they are to blame” - each teacher signs “ efficient contract”, where it is described in detail what he is supposed to. As for the salaries of the authorities, the answer states that the law provides that it can be eight times higher than the salaries of employees, although the ministry has the right to make this difference even greater. How much a rector receives is influenced by the assessment of the complexity of his work and the importance of the university.

The reply also includes a letter explaining the situation at MEPhI, which was mentioned by Kantorovich. The university claims that everything that happens is within the law, and no one received any 2 million. The average salary of the MEPhI faculty in 2016 was 99.4 thousand rubles. The average salary of the rector in the 1st quarter of 2017 was approved by the Ministry of Education at the level of 589 thousand; vice-rectors - 408 thousand.

Kantorovich, commenting on this information, emphasized: the given salary of teachers is doubtful. As for the salary of the rector and vice-rectors, the letter does not refer to their real salary, but to the salary approved by the department, and the amount of actual payments may be higher.

“I have no doubts that the NSOT does not have long to live - it created such a wild, life-contradictory practice,” Kantorovich concludes.

In practice, this led to a kind of legalized arbitrariness of the leadership of these institutions and is the main reason for the “unique phenomenon” in our country - the mass “poverty of workers.” ) state employees. Under the new system, the interests of superiors and employees are a priori opposite: the less the employer pays the employee, the more he can pay himself. With the same success it could be proposed to regulate collective agreement relationship between sheep and wolves.

Formally, when establishing the rules for remuneration in an institution, the team may disagree with something and object to something, but in reality the victory of the administration is predetermined: it is impossible to resist it in practice. For example, in my school Tekhnologii Teaching (Moscow), where disabled children study, when adopting the NSOT, the director grossly violated the regulations and humiliated teachers, pushing through his text of the Regulation on remuneration: all this is described in the article by the chairman of the trade union committee of our school, M.V. Filipenko “The story of an immoral slap in the face and a new system of remuneration” on the website of the trade union “Teacher”. As a result, the “director’s” Regulation was adopted at the school, which allows paying an employee in any position for work a salary with a difference at times, ignoring qualifications. - Do you understand that according to your "Regulations ..." for one lesson, a teacher can receive 300, 450, 600, 1200 rubles as the basic part of the lesson payment, that there is no such difference in any school? And what, say, a graduate can receive for the same workload 4 times more than a doctor of science with the highest category?

Ezdov A.A., director of the budget school, replied:

“Of course, I can pay a graduate if he works with a group of 5 people, more than a mossy PhD.”

And we paid like this for a year at school: the salaries of teachers for the rate differed by 4 times (without any additional payments, namely salaries). Appeal to the supervisory and law enforcement agencies did not give any result. They did nothing and often simply did not answer anything on the merits of the violations referred to in the complaints. As a result, even after my Open Letter to the Minister Olga Vasilyeva, published in the article “Technology of abomination. How to rob teachers and students according to the law ”, in 2017 I received only classic replies from the Ministry of Education and local bodies of the Ministry of Internal Affairs. The Ministry of Education actually confirmed the legitimacy of infringing on the rights of teachers and students: we draw up “savings” as a local act of the school and it becomes legal. And the Ministry of Internal Affairs, moreover, made more than one factual error in its response. Their presence and the inaction of law enforcement agencies are easily explained: they are inundated with complaints of general arbitrariness, and since each institution has its own documents composed in it, there is simply not enough physical strength and time to figure it all out.

Now teacher's salaries in our school are declining every year...But "saving" on teacher's salaries is just one of the forms of enrichment of the administration. Another financial scheme that operates at the school is the grouping of children who have a certificate of home education. Formally, such a reference automatically means highlighting budget financing for individual learning. This is how our school worked in the first years of its existence - and we were all proud of it, proud of how every seriously ill child is taken care of here, adjusting to his personal psychophysical abilities, etc.

Now groups are already formed by 8-10 people (children study remotely, communicating via Skype). The performance of students with disabilities sometimes falls catastrophically. But the school found a way out of this situation too: some of the students are transferred to the category of mentally retarded. I wrote about it in open letter Minister Olga Vasilyeva. In the response I received from the Ministry just nothing this situation has not been commented on. Meanwhile, turning children into mentally retarded schools is economically very profitable: they can reduce the number of lessons in the curriculum (and thus pay teachers less), and so on. And there is no particular responsibility for poor academic performance either. And the fact that later the state will receive instead of a citizen who is quite capable of finding a job, a “mentally retarded” citizen according to documents, requiring significant social subsidies, is no longer the concern of the school. (I deliberately speak only about the economic side of the issue, without considering the complete immorality of such a practice.)

This is not just the case in our school. Separately, I would like to comment on the president's words that the school itself determines the staffing table. As is known, according to May Decrees» Putin had to raise the salaries of state employees. Within the framework of the NSOT, the solution here is easy - you just need to get one person to do the work of two. In practice, this has led to the fact that the administration "survives" the employees to the maximum, and the rest are charged with their work. As a result, outside of Moscow it is already difficult to find a teacher who would work less than one and a half to two rates. As a result, the teacher either works to the point of wear and tear, or hacks.

And the way cleaners, nurses, nurses and social workers are bullied everywhere now is beyond imagination. Here is a story (December 2016) about a boarding school for bedridden children with disabilities: “In the same Cheremkhovo, there was a reduction in the positions of assistant educators with a monthly salary of 18 thousand rubles for nurses who receive 6-8 thousand rubles a month. The work is one and the same absolutely - this is confirmed by hundreds of interrogated workers of these categories. Only the load is different - for 32 children there were 111 staff units, then for 60 children - 125 units, then for 102 children - 137 units. That is, with an increase in the number of children in more than 3 times, the staff was increased by 24%. The workload has almost tripled. At the same time, the salary also decreased by 2-3 times ... What do nurses do in this institution. The same as in a regular hospital, but most of the children are severely disabled, bedridden with pelvic disorders, cognitive disorders, many of them need tube feeding, and these are children who do not behave calmly when feeding. Two whole sisters for a day! For all! And for honey. work, and tube feeding. For 120 children! And one of these sisters stays the night. One nurse per 120 seriously ill disabled children”. It is significant that this is not a journalist or a civil activist, but the head of the Investigative Department of the Investigative Committee of the Russian Federation for the Irkutsk Region, Major General of Justice Andrey Bunev.

Such cynicism, beyond imagination, towards the recipients of public services is now very widespread. For example, in the Russian Scientific Center for Roentgen Radiology, according to patients, almost all women are treated for breast cancer in the same way: the entire breast is removed at once. There is such a story on the net, dated 2011: “At the five-minute meeting, in the presence of all the doctors, director Solodkiy V.A. said, “She does not need a 6-hour complicated operation. How old is she? thirty? She doesn’t need to leave her breasts, take everything away – the operation will be short.” The doctors were shocked, but everyone was silent.” ". In 2011, they were in shock. And now, in fact, only such an operation is being done. Here are fragments of a letter sent to me by a patient in 2016: “The doctor did not do two important tests for me before the operation. But they refused to save the mammary gland, because "it is all amazed." After the operation, a histological examination of the removed tissues came. Skin, nipple, lymph nodes were clean. ... Wrote a complaint addressed to Professor Pavlov. There was an answer: yes, you asked for an organ-preserving operation, BUT YOU DID NOT REFLECT THIS IN THE CONSENT FOR THE OPERATION!!! Imagine the cynicism! This despite the fact that I was REFUSED in it, because “the entire mammary gland is affected.”

They were not going to save the mammary gland for me - it is long and expensive, and even a student-trainee will be able to remove it quickly and cheaply. The main thing: on the website of the RNCRR it is written that the treatment of the mammary gland is carried out according to world standards. In fact, during the 5 weeks of my stay, only one organ-preserving operation was performed. The rest - everything was removed: the mammary gland, skin, nipple, lymph nodes. Regardless of the age of the patient, the size of the tumor, the size of the breast, the result of the IHC, etc. They do the mutilation to save labor time and money”…

In general, each administration in its place comes up with new ways of working with budgetary funds. If you can’t force one person to work for two, then you can simply transfer a state employee to a part-time job while maintaining the same amount of work - this allows you to pay wages even below the minimum wage. And you can pay at full rate below the minimum wage, at least two thousand: according to the law, such a salary is acceptable. Ways to deal with checks from the authorities are now also worked out. Even if it pays an employee a salary below the minimum wage, it is almost impossible to catch him and bring him to justice. As soon as the school or hospital is informed about the test, the administration issues an order for the payment of incentives and bonuses to employees for the "test" period, and their total income legally becomes higher than the minimum wage. And if they are above the minimum wage, even if it is a beggarly 8,000, then law enforcement agencies no longer have reasons to initiate criminal cases: payments are above the threshold established by law, and everything is paid according to the Regulations on wages approved by the team itself.

“Having saved money”, managers write local acts, according to which they pay huge bonuses to themselves and those who they consider necessary. For example, the decision of the Legislative Assembly Chelyabinsk region dated December 22, 2016, No. 784, the amount of monthly monetary incentives for civil servants was increased from twelve official salaries to thirty-eight official salaries. The size of the bonus for the performance of particularly important and complex tasks has been increased from two to thirteen monetary rewards for persons holding certain public positions in the Chelyabinsk region. And who to pay monthly simply official salary, and to whom thirty eight such salaries, the head decides. And all according to the law.

And finally, I cannot but mention one more circumstance. Due to the miserable salaries of state employees, salaries in the private sector are also decreasing: in many small towns and villages, budgetary institutions are the main employer, and in the absence of an alternative in the form of decent budget salaries, a private trader can also reduce salaries at home. So, gradually, something like an economic gulag is taking shape in the country: let the people personally be free, but they work like oxen for meager food.

In my response, I kindly ask you, if possible, to take into account my comments and questions in connection with the response of the Ministry, set out in the publication of Novye Izvestia, “The Ministry of Education answered why the rector receives 2 million, and the teacher 20 thousand.” I also draw your attention to the fact that initially there was a crafty flaw in the calculation of the ratio of the manager’s salary to the “average” salary of the employee: the salary for the head’s rate is formed not on the basis of the average salary for the rate, but for the entire work of the employee (the fact that now many teachers work to survive, like oxen, at 1.5-2 rates, it is known). In addition, the “average” salary of an employee is calculated taking into account his bonuses and, in general, all salary payments. And the manager's salary is approved without these additional payments, as far as I understood from the response of the MEPhI administration.

In Open Letter No. 2, I want to show the practice of the current state of affairs in budgetary educational organizations on two examples.

The first example is about the situation with the salaries of teachers in Dagestan, described in the publication of the publication "Kavpolit" dated May 23, 2017 "Dagestan teacher asks Abdulatipov to pay attention to corruption in the school, otherwise she will go to a solo picket."

According to the Decree of the head of the administration of the city of Makhachkala dated June 3, 2010 No. 1667, the salary of 8912 rubles was set for city teachers. However, in reality, in the current academic year, seven (!) years after this Decree (let's not forget about inflation), teachers were not paid even this meager amount, but were paid 8,102 rubles each. Let's note: at first they themselves appointed this minimum, since according to today's law its size is under the jurisdiction of local authorities, and then they arbitrarily did not fulfill their obligations on budgetary (!) payments. And no one controlled this and did not think to change it, until the teacher Patimat Magomedshapiyeva from the Makhachkala secondary school No. 31 raised the issue of salary. The administration began to do something only after the literature teacher found out about the existence of Decree No. 1667 (and she simply has nothing to do in life, how to study the laws on wages). The administration realized that, from the point of view of the law, it smells like fried food. Morality has long been of no interest to anyone.

How does the administration act in such cases, in our case - the urban district "city of Makhachkala"? Issues a new Decree - No. 270 of March 1, 2017 "On Amendments to the Resolution of the Head of Makhachkala of June 3, 2010 No. 1667", which refers to the establishment of the salary of 8912 rubles for teachers with a higher qualification category. And this resolution is inscribed: "This resolution applies to legal relations that arose from September 1, 2016."

That's all. It's very simple: we issue another Decree, where we narrow the circle of teachers who can receive a salary of as much as 8,912 rubles. What happened next at school? “Despite the fact that in March the school still switched to paying a “new” salary, teachers began to receive even less in their hands.” That's all. Everything is legislated. Complete lawful arbitrariness: I turn what I want. And with complete impunity.

Below is an example of the second. I'm talking about the school where I work myself - full-time distance learning for children with disabilities GBOU TsO "Teaching Technologies" (Moscow). First, a story that repeats Dagestan one to one: about how laws are adopted that apply to legal relations that arose earlier. Since September 2014, one of the director's "savings" in the Teaching Technologies SC has been depriving disabled children who have reached the age of 18 from the opportunity to receive additional education. As soon as the student turned 18, right in the middle school year he was expelled from the number of students, stopped paying home Internet and took away the equipment (computer, etc.). On January 26, 2017, I wrote a letter to the administrator of the school: “... My students are removed from the load when they reach 18 years old. But, as far as I know, our students are allocated not only regular funding for additional education, but also funding under a special Moscow project, on the basis of which they are provided with equipment, this equipment is maintained and their education is financed from the budget (money is allocated for the work of a teacher). The contract with the students does not say anywhere that when they reach 18 years old, it is terminated. Why then are they removed? The result of this letter exceeded all expectations. Already on January 31, 2017, the Moscow Department of Education issued Order No. 30, according to which the training of disabled people under additional general developmental programs, to which they were enrolled before reaching the age of 18, is carried out until the end of the implementation period of these programs and applies to legal relations from September 2016. All students who were deprived of the opportunity to study (mind you, having received money from the budget for their education throughout the school year!), Returned the equipment and made a schedule.

At the same time, the Department does not consider it necessary to extend the possibility of budgetary receipt additional education disabled even before graduating from high school (we have a lot of children who turn 18 in the 9th grade, for example). He does not consider it necessary to issue a similar order for non-disabled people (now there are eleventh-graders who turn 18 while still at school): why such wastefulness in the management of city money allocated for additional education? Wouldn't it be better to "save" them? Moreover, this can be done with complete impunity and uncontrollable from above.

Combining disabled children who have a certificate of recommendation of home education and, accordingly, attract funding from the individual education budget, into groups (when the school started working, in 2006, all children studied individually - after all, then the laws did not allow transferring “savings” into salary payments). This allows, at a glance, to "save" several million a month from the money allocated for teachers' salaries.

Recognition of normal children as mentally retarded, because it is more economical. When I learned from Georgy G.'s mother that he had been recognized as mentally retarded and that a certificate had been read to him instead of a certificate, I was dumbfounded. I teach this inquisitive teenager with a good sense of humor. Mom, tired of fighting, plans to transfer him to another school so that there is not a certificate, but a certificate. I am ready to provide contacts of George's mother, with her consent. According to parents and teachers, Georgiy is far from the only such "mentally retarded" person at school. The mass recognition of many students of the school as mentally retarded took place in the 2015-2016 academic year.

Reduction in the number of operating school minibuses transporting children to school from ten to two or three.

While meals in the main building of the school are not organized at all (since children study mainly remotely), compensation for meals for days away from classes is not made. Here, however, it is not very clear who the “savings” are for - the Department or the school. And our children get sick a lot - sometimes for months. I know a mother who refuses her son to attend excursions held during school hours: after all, then she is not compensated for 150 rubles for that day.

Deprivation of graduates who graduated from school, computer equipment to which they are entitled by law.

Illegal prohibition for students to choose more than two circles of additional education to study with a teacher.

Arbitrary (underestimated) assignment of the size of a student-hour is the basis for calculating teachers' salaries.

Consistent reduction by “team decision” of the base salary of teachers for the same amount of work (without compensatory and incentive payments) since the adoption of the NSOT in 2013 by about 16-18 percent (in absolute numbers, excluding inflation). The details of how the team “decides” everything today are set out by me in the Novye Izvestia article dated May 12, 2017 “How to “earn” a salary of 2 thousand rubles a month.” According to the response of the Ministry of Labor, according to today's laws, the conditions for remuneration of workers in budget institutions fall within the competence of the institutions themselves. In practice, this led to the complete arbitrariness of administrations in the disposal of budget (!) Money.

The implementation of salary payments in the affiliated school not on the basis of the Regulations on remuneration, but on the basis of a local act written by the director himself: according to the Regulations, the remuneration of teachers would be significantly higher.

Teachers are paid only 21 working days in a month. If there are more working days in a month (for example, in March 2017 there were 23), they are not paid.

Believe me, Olga Yuryevna, these are far from all the ways of “savings” that are visible to the naked eye in our school. And the Department of Education invariably replies that everything is fine at our school. If you have a desire to deal with the "savings" in the GBOU TsO "Teaching Technologies", I ask you to address my letter to the Internal Affairs Directorate for ZAO Main Directorate of the Ministry of Internal Affairs of Russia for Moscow. Because the Department of Education will definitely not find any violations, there is no need to be a prophet. In GBOU TsO "Teaching Technologies" about three-quarters of the school's budget is "saved" offhand. According to the director's response, published in the article "Moskovsky Komsomolets" "Schools save on children in order to pay bonuses to directors", "any savings that arise at the Center from budgetary sources are directed to wages employees." It is not difficult to guess which employees. I think the top salaries in our school will impress anyone. I leave questions of morality behind the scenes.

In the bottom line, dear Olga Yuryevna, I ask you to realize all the abomination of the situation in which we have been brought by changes in the legislation of the last decade, allowing in practice the complete arbitrariness of local administrations in the management of the budget, allowing the administration to direct all the "savings" into the salaries of employees (in practice - to themselves and "their own"), reduce the number of jobs, etc. And this happens not only in education, but in all public sectors - health care, social security, and so on. In my opinion, the main reasons for the “unique phenomenon in Russia”, according to Olga Golodets, are the “poverty of the working people” and today’s general reduction in the social obligations of the state, the quality and volume of its services, are three:

a reform that changed the system of financing state institutions, according to which all budget money allocated to it remains within it,

the introduction of the NSOT, which lowered the formation of salaries to the level of institutions, and in practice allows for complete administrative arbitrariness in the formation of salaries,

broad independence and autonomy budget organizations, which allows local acts to change the staffing table, redistribute the allocated money for other purposes, etc.

Today, according to the law, employees have salaries of 2,000 rubles (see the article in Novye Izvestia about this, “A salary of a state employee of 2,000 rubles is quite possible and acceptable”). Budgetary administrations assign workers wages below the minimum wage (see, for example, the publication in Novye Izvestia, "Snickering" utility workers cannot get even two thousand rubles for work). In fact, an invisible economic GULAG is growing all over the country. Let the worker personally be free. But economically, he is no different from a prisoner of the Gulag - he works like an ox, practically only for food (after all, part of the salary goes to housing and communal services). Moreover, middle and junior managers, “feeders”, hide this state of affairs in every possible way, juggling statistics and drawing fantastic average salaries.

In conclusion, let me turn to you with a personal request. From the next academic year, the administration of the Teaching Technologies GBOU is depriving me of my favorite job of teaching the author's distance course "Bible Stories in the Masterpieces of World Art", which I have been creating for 10 years, simply excluding it from the curriculum and without even putting me on the list. fame (I know from my parents). I ask you to help to ensure that my courses on the study of paintings on the subjects of the Old Testament and the New Testament were returned to academic plan GBOU TsO "Teaching Technologies".
