1. From January 1, 2008, to provide employees of internal affairs bodies, organizations, divisions, institutions of the system of the Ministry of Internal Affairs of Russia and civilian personnel of the internal troops of the Ministry of Internal Affairs of Russia with annual additional paid holidays for continuous work experience in the system of the Ministry of Internal Affairs of Russia:

From 5 to 10 years - 3 calendar days;

From 10 to 15 years - 5 calendar days;

From 15 to 20 years - 10 calendar days;

2. Determine that:

2.2. The list of categories of employees who are entitled to additional annual paid leave for the special nature of their work, as well as the minimum duration of this leave and the conditions for its provision, are determined by the Government of the Russian Federation.

For me, as an employee of the Ministry of Internal Affairs, for many years of experience and the performance of a fairly wide range of official, often dangerous powers, the law establishes special guarantees, various compensation plans and preferential offers.

One of the most common guarantees is the provision of vacations on especially comfortable and favorable conditions. In the article I will describe what categories of recreation are available to employees of our field, what is the peculiarity of vacation benefits, how to write a report for the next days of rest. Each part of the question will be considered in as much detail as possible.

Without exception, all employees of the official department, according to a well-written report, are provided with two types of rest - the main one and holidays of an additional plan. The main category is the annual paid vacation. Additional ones include:

  • Going on leave for family personal reasons, a wedding, for example;
  • Yearly service;
  • For a study session at a university;
  • Holiday creative;
  • Official decree and subsequent child care;
  • Rest for a participant in military operations;
  • Retirement.

The time of vacations of the category of additional can be different - unplanned, if required by family circumstances, and planned in time, for example, fully paid study leave.

As for the duration of rest, it is determined by the head of the structural department in which the employee works, and personal circumstances and the current life situation also matter. Maternity leave

One of the most common options for a family vacation is the arrival of a baby. In this case, the father is given up to 10 legal days of rest, but more exact time defines leadership.

If a female employee of the Ministry of Internal Affairs goes on maternity leave, then she is given rest until the baby is three years old. The employee is entitled to a financial allowance until the baby is one and a half years old. This rule provided by current legislation.

The time period of the main vacation is 30 days. The provided period does not include holidays and Sundays, but Saturdays are included in the number of days. In the generally accepted system of holidays for employees of the Ministry of Internal Affairs, the time period of the prescribed rest is distributed according to a special schedule. Leave for employees of the organization of the Ministry of Internal Affairs is granted on the basis of such important documents as:

  1. A report written personally by a law enforcement officer. It is compiled in a special form.
  2. Vacation schedule drawn up and formally approved by the governing body.
  3. Official order of the head.

Rules for compiling a vacation report

Compiling a report is easy enough. At the very top of the document is a standard header, where the name of the unit, the name of the head is noted. Transfer and subsequent extension of vacation time

According to the current law for the Russian Federation, an employee in certain life cases can postpone the rest or, if necessary, extend it. This option will be most useful in such common life situations:

A feature of the rest of employees of the Ministry of Internal Affairs is that the authorities can recall them from vacation. A call can occur when one of two important conditions is met:

According to Article No64 of the Federal Law, a call is made only if, due to the absence of an employee, the organization cannot fulfill its direct duties.

At the same time, there is individual situations, under which the official recall of an employee of the Ministry of Internal Affairs is allowed, without obtaining his prior consent. Federal law defines all situations that fall under the definition of a state of emergency.

If, after the recall of an employee, he has unused vacation time, they are applied in any period that is comfortable for the employee. When the total duration of such time is 10 days or more, it is possible to increase its duration by the time that you need to spend on the road to the place of the planned vacation. In such a situation, the employee will be paid only the cost of travel.

Leave calculation rules

There is enough a large number of features that relate to the calculation of the frequency and time of vacations for employees of bodies. They must be taken into account in order to avoid possible errors. First of all, it is important to pay attention to the features of accruing annual leave. Here are the most basic ones:

  1. The main one is exactly 30 days.
  2. For the official length of service of the worked years, 15 days are required.
  3. Holidays - no more than 10 days.

At the same time, additional vacations are summed up and can be provided simultaneously with the main vacation or separately from it at the request of the employee. In this case, the total duration of an uninterrupted vacation should not exceed 60 calendar days (excluding travel time to and from the place of vacation). The duration of uninterrupted leave established by this part does not apply to an employee serving in the regions of the Far North, equivalent areas or other areas with adverse climatic or environmental conditions, including remote ones.

4.1. The duration of the leave granted to an employee of the internal affairs bodies in the year of the end of the leave to care for a child until he reaches the age of three years is determined by multiplying one twelfth of the main and additional leaves established for the employee in accordance with this chapter by the number of full months elapsed from the end parental leave until the end of the current calendar year. A vacation lasting less than 10 calendar days is added to the main vacation for the next calendar year.

5. Basic leave, leave for personal reasons, leave after graduation from an educational organization of higher education of the federal executive body in the field of internal affairs and leave granted to an employee of the internal affairs bodies in the year of entry into the service in the internal affairs bodies for a duration of 10 calendar days or more, increase by the number of calendar days required to travel to the place of vacation and back, taking into account the type of transport, but not less than one day one way. 6. In exceptional cases, when the absence of an employee of the internal affairs bodies in the service of the internal affairs bodies entails the impossibility of the proper implementation by the federal executive body in the field of internal affairs, its territorial body, subdivision of the functions established by the legislation of the Russian Federation, the time period for granting leave determined by the schedule may be transferred in agreement with the employee by order of the head of the federal executive body in the field of internal affairs or an authorized head.

7. Part of the main vacation of an employee of the internal affairs bodies, exceeding 30 calendar days, may be replaced by monetary compensation at his request in the manner established by the federal executive body in the field of internal affairs. An employee serving in the regions of the Far North, areas equated to them or other areas with adverse climatic or environmental conditions, including remote ones, as well as in harmful conditions, the replacement of part of the leave with monetary compensation, as a rule, is not allowed, with the exception of the case of his dismissal from service in the internal affairs bodies.

8. A female employee of the internal affairs bodies who is a mother (adoptive parent) is granted parental leave until the child reaches the age of three years in the manner prescribed by labor legislation. The specified leave can be granted to an employee who is a father (adoptive parent), guardian, grandmother, grandfather and actually caring for a child, only in the absence of maternal care for objective reasons(mother's death, deprivation of her parental rights, prolonged stay in a medical organization and other reasons) for the period of absence of maternal care. Such employee, insofar as it does not contradict this Federal Law, is subject to social guarantees established labor law.

9. An employee of the internal affairs bodies replacing the position teacher educational organization of higher education of the federal executive body in the field of internal affairs, the main leave and additional leave for length of service in the internal affairs bodies are provided, as a rule, during the vacation periods of cadets, students, except for the case when such an employee is provided with a voucher for treatment at another time .

Types of vacations for police officers - duration

It should be noted several types of such periods that are established for employees of the system of internal affairs bodies. But you need to understand that the duration of the vacation directly depends on the complexity of the duties performed and official position worker. However, there are a few general points:

  • The annual paid leave of police officers is granted for 35 days. This is the base value. The duration increases after 10 years of service by 5 days, after 15 - by another 15 days, and after 20 - by another 5 days. In addition, the duration increases by the number of days worked at night for daily duty, and so on;
  • study period. It is also paid and provided on a mandatory basis for studying at a university. Such periods can range from a few weeks to two months;
  • decree. The right to go on maternity leave to care for a child belongs to all employees, including police officers.

If the rest period was not fully used in a given year, the employee either receives compensation for this, or spends the remaining days next year.

Police leave for family reasons

This is a short period, which takes a maximum of three days. There are several circumstances under which the specified time may be granted:

  • death of a close relative;
  • own wedding;
  • another good reason is connected with the police officer himself or with his close relative.

The basis for granting such a period is an application. In this case, the application must contain an indication of a specific circumstance. In some cases, it will need to be confirmed in writing, because such days will be paid as working days.

How many days is such a period is indicated in the Regulations on the service in the Department of Internal Affairs. The main norms are contained in the labor legislation. According to them, every employee of the internal affairs body has the right to receive a short period in the event of the birth of a child.

As a rule, three days are provided. In fact, this is a family circumstance. Therefore, it is necessary to write a statement indicating the birth of a child as the reason.

The main vacation of a police officer - how many days is it?

As mentioned above, the main vacation of a police officer is 35 days. It does not include Sundays and public holidays. For example, if during the rest there are 5 Sundays and two holidays, then it will increase and amount to 42 days.

How many days of rest will also depend on the length of service. Besides, officials internal affairs bodies are on duty in investigative-operational groups, patrol the streets at night, and so on. Each such duty is compensated by rest days. And if the employee is a donor, then he also receives additional days.

On average, a standard rest is at least 40 - 45 days. If a person works in a temporary detention center or similar units, they are entitled to additional days.

Additional time is also provided for seniority. To find out how many days the rest will be, you should know exactly your preferential length of service. After all, some services count in the calculation of one year of work for one and a half years of service.

When the period of service exceeds 10 years, the employee will receive an additional 5 days. After 15 - his rest will increase by another 5 days and so on.

Length of service includes the time of study at the university. However, this period is not included in the calculation for the rest. That is, for calculating a pension, the length of service will be, for example, 10 years, and for rest it will be only 7.5.

This concept means a vacation of 30 days upon dismissal. It is granted three years before retirement, subject to service of 20 years or more. If retirement is due to an age limit or reduction, such time is given in the year of dismissal.

The same condition applies to the termination labor relations due to illness. At the same time, rest is paid according to the average daily earnings.

Types of vacations and the procedure for their provision to police officers.

For employees of the internal affairs bodies, the following types of leave are established with the preservation of pay:

1) main vacation;

2) leave for personal reasons;

3) vacation leave;

4) leave after graduation from an educational institution of higher professional education of the federal executive body in the field of internal affairs;

5) additional holidays;

6) other types of holidays if their payment is provided for by the legislation of the Russian Federation.

Another annual leave provided for 30 calendar days, and for areas with severe and adverse climatic conditions - 45 calendar days.

Note that when determining the duration of the main vacation, weekends and non-working holidays (but not more than 10 days) falling on the vacation period are not included in the number of calendar days of vacation.

Other types of holidays

16. Types of disciplinary sanctions and the procedure for their application in the police.

Article 50. Disciplinary penalties

1. The following disciplinary sanctions may be imposed on an employee of the internal affairs bodies in case of violation of official discipline, as well as in other cases provided for by this Federal Law:

5) transfer to a lower position in the internal affairs bodies;

6) dismissal from service in the internal affairs bodies.

14. A disciplinary sanction imposed on an employee of the internal affairs bodies by an order of the head of the federal executive body in the field of internal affairs or an authorized head is valid for one year from the date of its imposition, and a disciplinary sanction announced publicly orally - within one month from the date of its imposition. A disciplinary sanction imposed on an employee by an order of the head of the federal executive body in the field of internal affairs or an authorized head is considered withdrawn after one year from the date of its imposition, if this employee has not been subjected to a new disciplinary sanction during this year.

15. Disciplinary sanctions provided for in Clauses 5 and 6 of Part 1 of Article 50 of this Federal Law shall be executed no later than two months from the date of issuance of the order to impose them. The specified period does not include periods of temporary disability of an employee of the internal affairs bodies, his being on vacation or on a business trip.

16. Execution of the imposed on the employee of the internal affairs bodies disciplinary action in the form of a transfer to a lower position in the internal affairs bodies is carried out in the manner established by Article 30 of this Federal Law.

17. The execution of a disciplinary sanction imposed on an employee of the internal affairs bodies in the form of dismissal from service in the internal affairs bodies is carried out in accordance with Chapter 12 of this Federal Law.
