1) state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order, sending a copy of it for official publication in print periodicals and in the information and legal system "Adilet";

3) placement of this order on the Internet resource of the Ministry of National Economy of the Republic of Kazakhstan.

3. To impose control over the execution of this order on the supervising Vice Minister of the National Economy of the Republic of Kazakhstan.

4. This order shall enter into force upon the expiration of twenty-one calendar days after the day of its first official publication.

Regulations and permit requirements
on certification of engineering and technical workers participating in
design and construction process
1. General Provisions

1. These rules and permit requirements for the certification of engineering and technical workers involved in the design and construction process (hereinafter referred to as the Rules and permit requirements) are developed in accordance with the Law of the Republic of Kazakhstan dated July 16, 2001 "On architectural, urban planning and construction activities in the Republic Kazakhstan" and determine the procedure for attestation of engineering and technical workers carrying out activities in the field of architectural, urban planning and construction activities.

2. In these Rules and permit requirements, the following concepts are used:

1) certification - the procedure for official recognition by the certification center of the powers of engineering and technical workers involved in the design and construction process;

2) certification center - entity that has passed the accreditation procedure in the authorized body in accordance with the established procedure;

3) qualification certificate - a certificate certifying the status of an engineering and technical worker in the form in accordance with Appendix 1

4) engineering and technical worker - individual who has a secondary vocational or higher education, organizes and manages production process in the field of architecture, urban planning and construction;

5) applicant - an individual applying for a qualification certificate;

6) authorized body - department of the central government agency in charge of the field government controlled architectural, urban planning and construction activities.

3. Certification is carried out in order to determine the level of professional training and competence of engineering and technical workers, knowledge of state standards in the field of architecture, urban planning and construction, improve the quality of their work, study new requirements, taking into account changes taking place in the construction industry.

4. Certification is carried out for applicants and engineering and technical workers as part of design or construction and installation organizations.

5. The composition of engineering and technical workers of design and construction and installation organizations is divided into specializations in accordance with the Qualification Directory for the positions of managers, specialists and other employees, approved by order of the Minister of Labor and social protection population of the Republic of Kazakhstan dated May 21, 2012 No. 201-ө-m (registered in the Register of State Registration of Regulatory Legal Acts No. 7755).

6. Permit requirements for education and work experience of engineering and technical workers are specified in Appendix 2 to these Rules and permit requirements (hereinafter referred to as permit requirements).

2. Certification procedure

7. For certification, applicants send the following documents to the certification center:

1) an application in the form in accordance with Appendix 3 to these Rules and permit requirements;

2) a copy of the identity document of the applicant;

3) a notarized copy of a diploma of higher professional education (in the presence of an academic degree and academic title - copies of the relevant documents);

4) a notarized copy work book or other documents confirming the work experience;

5) notarized copies of foreign certificates, attestations and other documents confirming qualifications in the relevant specializations, if any.

Notarization is not required if the applicant submits the original document for verification to an employee of the certification center.

8. In case of submission of an incomplete set of documents for certification, the certification center does not accept the submitted documents of the applicant.

9. The term for consideration of the application from the date of submission of the package of documents to the certification center is 15 (fifteen) working days.

10. Documents for compliance with permit requirements are considered by a responsible officer appointed by order of the head of the certification center.

11. Based on the results of consideration of the submitted documents for compliance with the permit requirements for certification of engineering and technical workers involved in the design and construction process, specified in Appendix 2 to these Rules and permit requirements (hereinafter referred to as Appendix 2), within one working day, the order of the certification center approves testing schedule and an order in which the following decisions are made for each applicant:

1) admitted to testing;

2) not allowed to test.

12. The Certification Center notifies applicants of the place, date and time of testing, or of the reasons for non-admission to testing in writing within three working days from the date of signing the order.

13. Testing is carried out no later than five working days from the date of notification of the applicant and provides for the following requirements and procedures:

1) testing by an automated computer method in the state or Russian languages ​​at the choice of the applicant;

2) the admission of applicants for testing is carried out upon presentation of an identity document;

3) employees of the certification center familiarize the test-takers with the testing procedure;

4) the applicant is not allowed to talk and leave the premises during testing, use personal electronic devices (including computers, Cell phones) and paper media during testing;

5) employees of the certification center remove from testing applicants who violate the requirements and procedures for testing specified in paragraph 13 of these Rules and permit requirements, with the preparation of an appropriate act (in any form);

6) the calculation of the correct answers of computer testing is carried out automatically by a computer program;

7) familiarization with the test results is carried out immediately after the completion of the test.

14. The time allotted for testing is 120 minutes. The test consists of 100 questions on the chosen specialization. Test questions are developed and approved by the authorized body.

15. The threshold level for passing the test is:

1) for applicants specified in subparagraphs 1, 2, 3, 5 and 6 of the permit requirements for attestation of engineering and technical workers involved in the design and construction process, specified in Appendix 2 to these Rules and permit requirements - 70 correct answers;

2) for all other applicants - 60 correct answers.

16. The number of re-attestation retakes is not limited.

17. Based on the test results, one of the following decisions is made for each applicant:

1) certified;

2) not certified.

18. The Certification Center, within two working days from the date of the test, issues a completed qualification certificate to the applicant in case of passing the test, or notifies in writing about the failure to pass the test.

19. The results of certification are approved by the order of the certification center.

20. Information about certified engineering and technical workers is posted on the official Internet resource of the authorized body.

21. On a monthly basis, by the 10th day of the month following the reporting month, the Certification Center sends the following information to the authorized body:

1) the number of issued qualification certificates included in the Register of certified engineering and technical workers in the form in accordance with Appendix 4 to these Rules and permit requirements;

2) the number of refusals to issue qualification certificates;

3) full list persons applying for qualification certificates.

What categories does the concept of ITR include

Engineering workers are all those who can be classified as managers, specialists or technical performers. The category of leaders includes those who manage both the entire organization and its individual services and divisions, as well as deputies of the latter.

ENDS professionals fall into one of several different groups. The first group is those who are employed in jobs related to agriculture or forestry, animal husbandry, and fish farming. The second - workers in the economic or engineering and technical spheres. The third group of specialists work in the field international relations. The fourth group - workers in the sphere of art, culture, science, education, health care. Fifth - legal profile. Thus, we see that the circle of specialists is quite wide.

Technical executors are employees whose task is to account, control, prepare the necessary documentation and its execution, as well as economic services. Thus, the concept of ITR is morally obsolete, the decoding of which is no longer so relevant. It has been replaced today by the concept of administrative and technical personnel (or ATP).

List of engineering positions

Development scientific and technological progress leads to a strengthening of the function of those who are commonly called engineering and technical workers. Their number relative to the total number of all categories of workers is growing, especially in such sectors as industry and construction.

Who exactly can we rank in the mentioned category without the risk of making a mistake? If we focus on the old Model list of positions based on the Decree of the Council of Ministers of the USSR N 531 (for 1973) and approved in 1979, then we are talking about managers (except for those who are appointed to positions by higher bodies), chief (senior) specialists various names, heads of offices, industries, farms, services, branches, sections, bureaus, inspections, departments and departments, stations, offices, warehouses, workshops, storage facilities, laboratories, groups, points, sectors, sites, reserves, expeditions, bases, parks, nurseries, cameras and cash desks.

Who else is in this category?

Who else is an IT worker? The list of them is quite long. The principle of remuneration of engineers and technicians

Such employees receive wages for the performance of their duties in the form of an official salary. That is, some fixed amount, established by the administration of the enterprise and depending on the degree of complexity, as well as the volume of duties performed, the role and importance of this particular position in the work process and immediate working conditions.

The size of the official salary is negotiated when a specialist or manager is hired and does not depend on the production results of the enterprise or a particular unit.

Evaluation of the work of engineering and technical personnel is carried out in terms of completeness, quality and volume, as well as the timely execution of their assigned duties.

Thus, the category of engineering and technical workers pay for their work has a time-based nature. Depending on the position held, one's own qualifications, the level of complexity and volume of duties performed, as well as working conditions in a particular industry, a system official salaries for all types of IT. Is it just a "bare" salary?

In addition to fixed salary amounts, there is a system of additional payments, allowances and various bonus payments.

Such employees are rewarded in connection with the growth of output and a decrease in its cost, compliance with contractual obligations, an increase in labor productivity, and savings in raw materials and fuel.

On the regulation of labor engineering

The task of a competent organization of the work of employees and engineers in order to improve the structure of the administrative apparatus, optimize the use of working time and reduce costs involves rationing. Any type of work of a managerial nature can be normally organized only if there is specific information about the amount of time and the number of employees required for its implementation.

Compared with the worker's labor rationing, the same procedure for engineers and employees is a more difficult task. Indeed, in this case, we are dealing with a process with a predominance of mental labor, which is not directly measurable. For example, a production engineer does not stand directly behind the machine - he directs the process. So how do you rate his work?

The main task in rationing the activities of such employees is to establish the complexity of each type of work that they perform, and the calculation of the required number of employees. Both activities are intertwined. The first one is necessary for successful separation job duties and optimal distribution of workers in accordance with qualification characteristics.

Secondly, the establishment of the numerical strength of this category of workers serves to establish the optimal proportions between individual positions, to build the management apparatus in a rational way, to plan the required staff and payroll.

According to the Order of the Minister national economy RK dated November 26, 2015 No. 734, engineering and technical workers participating in the design and construction process (hereinafter referred to as engineering and technical personnel) are subject to certification.

Also.

Applicants who have applied for a license for design activities and construction and installation works, and licensees carrying out these types of activities, must have certified engineering and technical workers in their composition.

Wherein:

  • Accounting for all information on issued certificates is kept in a single state register;
  • The qualification certificate is issued for engineers;
  • An engineer is required to have relevant work experience and education (at least 3-5 years, depending on the position, according to permit requirements) - to obtain a certificate;
  • The certificate is termless;
  • Combining the work of engineering and technical personnel in other organizations carrying out these types of activities is not allowed.
  • When an employee transfers to another company, a corresponding mark is made in the unified state register.

Where and how can I get a qualification certificate?

Knowledge testing with the subsequent issuance of certificates is carried out by certification centers operating on the basis of accreditation certificates issued by the CDS and housing and communal services of the Republic of Kazakhstan.

Procedure and terms for obtaining a qualification certificate:

1. The applicant (an individual working in a design or construction and installation company) submits to the certification center an application for the issuance of a qualification certificate (according to the established form) along with notarized copies of documents confirming his education, qualifications and work experience.

Consideration of the application and the package of documents takes up to 15 working days.

2. After consideration of the documents and the application - an order is issued - the applicant is admitted to testing, or not; and also - approves the schedule for certification within 1 business day.

3. Within 3 working days the applicant is notified in writing(or by e-mail) on the date, place and time of the certification (with confirmation of receipt in writing or electronic form).

4. Testing is completed within 5 working days days from receipt of the notice. Conducted in the state or Russian languages ​​- the test consists of 100 questions, for which 120 minutes are given.

5. Based on the results of testing, a decision is made on the applicant - "Certified" or "Not certified". Thereafter - within 2 working days- the applicant is issued a qualification certificate, confirmed by the order of the certification center.

New requirements for SRO members

From now on individual entrepreneur or the head of the legal entity organizing the core work must personally have higher specialized education and professional experience at least five years to become a member of the SRO and obtain permission to work - this is indicated in new edition Part 6 Art. 55.5 GrK.

Especially this news, presumably, will please the builders of the old school, who at one time limited themselves to a technical school, and then went through the industry from top to bottom, sorting out everything from their own experience. And university teachers themselves could learn a lot from these people.

Now, as for the specialists from the Unified Register. The minimum bar for the number of such specialists at the main place of work per SRO member is two specialists.

In principle, the SRO can independently set higher standards for types of work with increased responsibility. However, we remember that self-regulatory organizations and earlier they had the right, for example, to establish higher contributions to the Komfond - and did not use it. Of course, because this would immediately reduce the attractiveness of a particular organization for those who join.

All about specialists from National registries

Now we will deal in detail with the requirements for specialists in the organization of construction, design and survey, which they must meet in order to be included in the registers of NOSTROY and NOPRIZA, and the further responsibilities of these specialists.

Requirements

In order for an engineer or architect to be included in the relevant register, he must have the following:

  1. higher diploma vocational education in the field of construction;
  2. work experience in engineering positions - from three years;
  3. total work experience in the field of construction - from ten years;
  4. advanced training in the field of construction - not earlier than five years ago;
  5. work permit (for foreign citizens).

Responsibilities

However, it is not enough just to have these specialists on staff. These people will also have to perform some key functions in the company.

For construction specialists from the NOSTROY registry, these functions are as follows:

  1. organization of incoming control of project documentation;
  2. construction control in the course of the company's work;
  3. acceptance of finished views and individual stages of work;
  4. signing of the following documents:

    • act of acceptance of the capital construction object;
    • confirmation that the constructed or reconstructed capital construction facility complies with the requirements of technical regulations;
    • confirmation that the parameters of the constructed or reconstructed capital construction facility comply with the project documentation, including the requirements for energy efficiency and equipment with metering devices for the energy resources used;
    • confirmation that the constructed or reconstructed capital construction facility complies with specifications connections to engineering and technical support networks (if any).

As for the specialists organizing design and engineering surveys from the NOPRIZA register, their duties will be as follows:

  1. preparation and approval of tasks for the performance of work by the company;
  2. determination of criteria for selection of participants in the company's work;
  3. presentation, approval and acceptance of the results of the company's work;
  4. approval of the results of the company's work.

The twist is that these responsibilities make it extremely difficult for a company to formally use third-party work managers. Because these specialists will have to sign rather serious things - and then answer for their truth. Including its presence in the register of specialists. However, we will return to this later.

And now let's look at how specialists get into a single register initially.

How can a specialist get into the Unified Register?

Exclusion from the register is a serious measure that jeopardizes the activities of not only the excluded specialist, but also the entire company in which he works - after all, the company at this moment, most likely, ceases to comply with the requirements of the SRO and may lose its admission.

Can be excluded from the register:

  • at the request of the specialist himself;
  • due to the death of a specialist;
  • if the specialist is a foreign citizen, and his residence or work permit has expired;
  • if, through the fault of this engineer or architect, money was paid from the SRO funds, and his guilt was established by the court (in this case, he may again be in the register no earlier than three years later);
  • if the specialist was twice brought to administrative responsibility for similar offenses while working on the same object (the waiting period is also three years);
  • if, due to the actions of a specialist, an individual entrepreneur or a legal entity for which he works is in the register unscrupulous suppliers, and the fault of the specialist is established by the court (the waiting period is also three years).

What to do when the law on the register of specialists comes into force?

All current work permits will expire on July 1, 2016. After that, builders, designers and surveyors will have to confirm their right to be a member of the SRO - now according to new requirements.

Fortunately, you still have enough time to improve your specialists to meet the requirements for them - for example, send them to advanced training if the last such promotion was completed more than five years ago.
