On July 15, 2016, Federal Law No. 290-FZ came into force, which amends Law No. 54-FZ “On the use of cash register equipment”

Now most businessmen must switch to online cash registers, and all cash register equipment will send electronic versions of checks to the Federal Tax Service via the Internet. The electronic tape will need to be replaced with a fiscal drive, connect the cash register to the network and enter into an agreement with the fiscal data operator to send checks.

Online cash registers in 2017: basic provisions

1. The scheme of working with tax authorities has changed; all data from checks will be sent to the Federal Tax Service via the Internet.

2. Registration of a cash register has been simplified, no need to go to the tax office, just go to the website nalog.ru and register the cash register via personal account.

3. Entrepreneurs who do not currently use cash registers will be required to purchase online cash registers and send data to the tax service by July 1, 2018.

4. Changes also affected checks and forms strict reporting, now the amount of data that must be present in them will increase.

5. So-called fiscal data operators have appeared; they will receive, store, process and transmit fiscal data to the Federal Tax Service.

6. Cash registers will technically become a little different, EKLZ will replace the fiscal drive.

7. Not everyone will be required to use online cash registers; there is a list of activities that will not need a new cash register.

Application of CCP in 2017 - how it will be

The buyer comes to the store to make a purchase, the cashier scans the barcode on the packaging, the fiscal drive located inside the cash register saves the receipt, signs it with a fiscal sign, and sends the receipt data to the OFD. The fiscal data operator processes the information, sends the response back to the cash register, and the data on the check to the Federal Tax Service.
Next, the buyer receives a check, or 2 checks if desired (one paper and one electronic, by mail or telephone)

Therefore, in accordance with law 54-FZ, all points of sale must be connected to the Internet.
But it is worth noting that the check processing speed will not depend on the Internet speed, the data will be transmitted in parallel and even if the network is lost, the information on the check will be transferred to the OFD later, as soon as the connection is restored.

Mandatory details of checks and BSO for online cash registers

In view of the new requirements that relate to cash registers, new requirements have emerged that are now applied to checks and BSO. in them mandatory there should be the following information:

- calculation indicator (income or expense)

- form of payment (cash or electronic payment)
- calculation amount with a separate indication of the rate and amount of VAT
- serial number of the fiscal drive
- date, time and place of settlement
- name of goods
- phone number or email of the buyer, if the check or BSO is transferred to electronic form

Registering a cash register with the tax office: how to register a cash register in a new way

Registering a cash register with data transfer with the tax office will be much easier and faster than a regular one. The owner will only have to register on the tax service website nalog.ru and leave a request for fiscalization of the cash register, then sign the application with his electronic signature and wait for confirmation.

After the tax office receives this information, she will send the registration data to the entrepreneur, and the fiscal data will be entered into the device. Now you will not need to visit the Federal Tax Service in person with a cash register, or enter into an agreement with the central service center.

Cost of online cash register

After the law officially came into force, it became clear that the use of online cash register systems for businesses would become mandatory. Let's figure out how much an online cash register costs and what the cost of the most budget online cash register will consist of:

1. Fiscal registrar - manufacturers say that the cost of fiscal registrars with a fiscal drive will not exceed the cost of conventional ones. Let's take into account the minimum price of 20,000 rubles. Modernization kits will cost an average of 5 to 15 thousand rubles.

2. The agreement with the Fiscal Data Operator will cost 3,000 rubles per year.

3. The services of the central service center are officially no longer needed, we will not take them into account.

4. Cash register software - here the cost may vary dramatically, but we will take an average of 7,000 rubles. for one online checkout.

Thus, we calculated that the minimum cost of switching to online cash registers using software and a fiscal registrar will be about 37,000 rubles (using modernization kits, you can save up to 10 thousand rubles). But if we consider traditional POS terminals, the cost will immediately increase by at least 2 times.

Transition to online cash registers from 2017: stages and deadlines

1. For those entrepreneurs who were allowed not to use cash register systems, a deferment is provided until 07/01/2018.
2. Vending companies also received a deferment until July 1, 2018.
3. In addition, the law contains a list of types of trade in which it is permitted not to use cash register equipment online.
4. Anyone who does not fall into the 3 points described above is required to use online cash registers from July 1, 2017. And from February 1, 2017, it is no longer possible to register an old-style cash register.

Is it possible to buy cash register online now?

New cash register equipment is now actively on sale, but it is worth noting that old-style equipment that was registered before 02/01/2017 can be used without problems until 07/01/2017. But be careful, don’t put off buying an online cash register until the last date; experts predict a shortage of cash register equipment in 2017 and you won’t be able to buy cash registers online quickly.

Failure to use cash registers or incorrect use of cash register equipment may result in fines:
1. CCP does not meet the requirements - 10,000 rubles.

54-FZ. New procedure for using CCP from 2018

  • Only individual entrepreneurs who sell goods received a deferment from online cash registers until 2021 own production, perform work or provide services and do not have employees employment contracts.   • Although the transfer of data to the tax office has become an online procedure, Law 54-FZ “On the Application of Cash Registers” does not contain provisions stating that it is not necessary to issue a paper check in 2020. At the buyer's request, you need to send him a document by email or SMS in addition to the one printed on the cash register. An electronic check is equivalent to a paper one. In this case, the courier may not punch the cash receipt. It is enough to show the buyer the QR code that will download the electronic one. You don’t have to take the cash register with you: you can use it remotely.
  • Since 2018, the CCP Law requires more data to be indicated on checks and strict reporting forms. For example, a list of sold goods (indicating prices, discounts), the serial number of the fiscal drive and the phone number or email of the buyer, if the document is transmitted electronically.   • Entrepreneurs with patents and UTII were also affected by changes in 54-FZ: in 2018, they also began to install cash registers, although previously they were generally exempt from using cash registers. Only individual entrepreneurs who sell goods of their own production, perform work or provide services and do not have employees under employment contracts received a deferment for online cash registers until July 1, 2021.   • The costs of purchasing a cash register can be deducted from tax - up to 18,000 rubles for each device. But not everyone.

  • You can also deregister a cash register without visiting the tax office - through your personal account on the Federal Tax Service website. But the tax office can do this forcibly.
  • Checks from payments to the bank account. From July 1, 2019, an entrepreneur is required to issue a cash receipt when payment is received from individual to the organization's bank account.
  • Prepayment receipts. From July 1, 2019, you need to issue two checks. One - upon receipt of an advance payment, and the second - upon the transfer of goods or provision of services. Good news: in MyWarehouse it is very simple.

Using cash registers in 2020 - what it looks like in practice

When the cash register is registered, the seller begins to work with it. The use of cash register systems in 2020 is generally no different from usual work. The buyer pays for the goods and receives a receipt - now electronic. The fiscal registrar sends information about the sale or return to the fiscal data operator. The OFD processes the information, sends confirmation back to the cash desk, and the data to the tax office. All information is transmitted in parallel with the receipt, that is, the customer service time does not change.

New rules for the use of cash registers in 2018 helped the state make trade transparent. But for entrepreneurs, re-equipping the cashier's place is an additional cost. What are the consequences of incorrect use of cash register equipment in 2020?

The tax office has already issued the first fines for violating the requirements of 54-FZ. For failure to use a new cash register, an entrepreneur may be fined 25–50% of the amount passed through the cash register, but not less than 10,000 rubles. Organizations - 75–100%, but not less than 30,000 rubles. For using a cash register that does not comply with the requirements of the law, an individual entrepreneur faces a fine of up to 3,000 rubles, and a company - up to 10,000 rubles. In the event of a repeated violation, if the settlement amount is more than 1 million rubles, the activities of the entrepreneur or organization may be suspended for up to 90 days.

Since July 1, 2018, fines for incorrect use of cash registers have increased. Amendments have been made to the Code of Administrative Violations - now they will also punish for fictitious cash register checks. They will be able to recover up to 40,000 rubles from companies, and up to 10,000 rubles from individual entrepreneurs. The Federal Tax Service will also be able to fine organizations up to 100,000 rubles, entrepreneurs up to 50,000 rubles for incorrectly indicated goods on a receipt or untimely transmission of fiscal data. If an individual entrepreneur or company is caught violating it again, and the settlement amount is more than 1 million rubles, the fine will range from 800,000 to 1 million rubles.

In addition, tax officials will have the right to block the operation of cash registers that were used during the violation. This will be possible in the presence of two witnesses or using video recording.

In this case, the tax regime, even if it is or for which there is a deferment, does not matter. In this situation, the deferment until 2018 ceases to apply. Step-by-step instructions for switching to online cash registers

We will divide the entire process of changing the old-style cash register into several steps. So, you should start with preparatory activities, then purchase new device or upgrade the old one, and finally install new cash register registered with tax authorities.

Step 1: We study the law on the use of cash registers and determine whether you need to use a cash register in your activities, as well as when exactly this obligation to use it occurs.

If from mid-2017, there is not much time and work on replacing the cash register should begin now, if from 2018, measures to replace the cash register can be postponed for now.

Step 2: Let's find out whether it is possible to upgrade the existing CCP to meet the new requirements.

If it is impossible to modernize or you did not have a cash register in the first place, then you need to look at the list of equipment that meets the new requirements of the law and select the model that is suitable for you. With these questions, you can contact the CCP manufacturers or the center maintenance with whom you are working.

Some cash register models cannot be upgraded, while others do not yet have an upgrade kit. In the second case, such an upgrade kit can be waited if it is practical and you have confirmation from the manufacturer that it is being developed and will be released soon.

Step 3: Determine what makes more sense for you: buy a new cash register or modernize the old one?

The decision must be made primarily based on the expected costs. It is logical that you should choose the cheaper option. But cost is not always decisive; other factors can also have an impact, for example, the number of cash registers that need to be changed, the specifics of the activity, and further plans for business development.

If you have several cash registers that need to be replaced, for example in different retail outlets, that is, it makes sense to draw up a schedule for their modernization and replacement.

Step 4: We buy either a new cash register or a kit for upgrading an existing device.

Plus, you should purchase the necessary cash register software. The cash register salesperson will advise you on these issues.

Step 5: We deregister with the tax authorities old cash register even if we only upgrade it to new requirements.

After 07/01/2017, all old cash registers that have not been deregistered by the owners will be removed automatically as not meeting the requirements - be careful and do not delay the process of replacing cash registers.

Step 6: We bring cash register equipment into condition for new registration.

For those who bought a new cash register, you need to install the device itself, update software, provide other technical issues (access to the Internet, etc.). For those who are upgrading an old-style cash register, after deregistering the equipment, it is necessary to install a modernization kit, remove the ECLZ and replace it with a fiscal drive, and update the software.

Both the manufacturer's representatives and the technical service center with which you worked previously can help you install the upgrade kit.

Step 7: We enter into an agreement with the fiscal data operator (abbreviated OFD).

This requirement is mandatory; without it, the Federal Tax Service will not register your cash register.

OFD – an intermediary between the seller and tax authorities, who ensures the transfer of revenue data. Only Russian company, which has permission for such activities.

Step 8: We register the new/updated cash register with the tax office.

Here the sequence of actions looks like this:

  1. We draw up and submit an application for registration of a cash register. This can be done either online through the cash register account on the Federal Tax Service website (you will need electronic signature), or in paper form in any tax office(previously you could only go to your own).
  2. The tax office informs you of the registration number of the cash register, which will not change during the entire period of use of the device.
  3. You write this number into the fiscal drive. You will also need to provide other information, for example, the name of the organization or full name of the individual entrepreneur and other details. After filling out all the required information, you need to generate a registration report and submit it to the tax office. This can already be done in three ways: on paper, electronically through the cash register office or through the OFD. These actions must be carried out no later than the business day following the day you receive the registration number from the tax service.
  4. Within 5 working days, tax officials register the cash register and send you a registration card. You receive it through the CCP or OFD office in electronic form, if you need a paper version, contact the tax office, they should print it out for you.

Step 9: The cash register is installed and registered, you can work on it.

The Federal Tax Service website has a special section dedicated specifically to online cash registers. Online cash registers for UTII and PSN

Businessmen on a patent, as well as firms and individual entrepreneurs on “imputation”, for types of activities that fall under UTII, are allowed to conduct payments without cash registers, including with an online element. In this case, a mandatory requirement applies: at the request of the buyer or client, it is necessary to issue a document confirming the acceptance of money for work or service. From February 1, 2021, merchants on a patent, “simplified”, unified agricultural tax, “imputed” will have to reflect on cash receipt and BSO name of the product (work, service) and its quantity. The only exceptions were individual entrepreneurs selling excisable goods.

What is an online cash register

An online cash register is a cash register that meets new requirements:

  • prints the QR code and link on the receipt,
  • sends electronic copies of checks to OFD and customers,
  • has a fiscal drive built into the case,
  • interacts freely with accredited OFDs.

All requirements for online cash registers are described in the new law and are mandatory for all cash registers from 2017.

An online cash register is not necessarily a completely new cash register. Many manufacturers are refining previously released cash registers.

For example, all cash registers and fiscal registrars of Wiki can be upgraded to an online cash register. The price of the modification kit is 7,500 rubles. The total takes into account the cost of the fiscal drive (6,000 rubles), nameplate and documentation with the new cash register number (1,500 rubles). Software updates on all Wiki cash desks occur automatically.

New cash registers (modified and completely new) are included in a special register of cash register models and approved by the Federal tax service.

How does the online cash register work and what should now be on the receipt?

If the buyer asked to send an electronic copy of the check, then in the paper one you need to indicate email client or his subscriber number.

The sales address varies depending on the type of trade. If the cash register is installed indoors, you must indicate the store address. If trade is carried out from a car, then the number and name of the car model are indicated. If the goods are sold by an online store, then the website address must be indicated on the receipt.

The cashier's last name does not need to be indicated on receipts from online stores.

New terms

Fiscal Data Operator (FDO)- an organization responsible for receiving and transmitting fiscal data to the tax office. The Operator also stores this information for 5 years and ensures that copies of electronic receipts are sent to clients. The list of accredited OFDs is presented on the Federal Tax Service website.

Register of online cash registers- this is a list of cash register equipment that is ready to work according to the new rules and officially approved by the Federal Tax Service of Russia. As of December 2016, the register of cash register equipment contains 43 cash register models. The list is updated and anyone can view it on the tax website. Each specific cash register is also entered into the register of cash register copies.

Fiscal storage encrypts and transmits fiscal data to the OFD. FN came to replace EKLZ.

Fiscal data— this is information about financial transactions carried out at the checkout. Technical requirements to the fiscal drive are described in the law; now there is one model of fiscal drive available on the market for purchase. Each copy of the FN is also included in a special register.

Validity period of the fiscal accumulator It is different for all entrepreneurs and depends on the applicable taxation system:

  • OSNO - 13 months
  • USN, PSN, UTII - 36 months

The beginning of the service life of a fiscal drive is the date of its activation. The owner of the cash register is obliged to store the FN after replacement for 5 years.
