I. The procedure for the formation of technological fuel reserves at power plants and boiler houses of the electric power industry

1. The procedure for calculating and justifying the standards for the creation of fuel reserves at thermal power plants and boiler houses establishes the basic requirements for the rationing of technological fuel reserves (coal, fuel oil, peat, diesel fuel) in the production of electrical and thermal energy.

2. The standard for the creation of technological fuel reserves at thermal power plants and boiler houses is the total standard fuel reserve (hereinafter - ONZT) and is determined by the sum of the volumes of the irreducible standard fuel reserve (hereinafter - NNF) and the standard operational reserve of the main or reserve fuels (hereinafter - NEZT) .

3. NNZT ensures the operation of the power plant and the boiler house in the "survival" mode with a minimum design electrical and thermal load under the conditions of the coldest month of the year and the composition of the equipment that allows maintaining positive temperatures in the main building, auxiliary buildings and structures.

4. NEZT is necessary for the reliable and stable operation of power plants and boiler houses and ensures the planned generation of electrical and thermal energy.

5. Regulation of actions with NCC at thermal power plants and boiler houses is necessary in order to prevent the consequences of a complete shutdown of power plants or boiler houses and related long-term restrictions and disconnections of consumers.

6. The regulation of NEZT at power plants and boiler houses, in addition to ensuring reliable and stable operation, is also necessary in order to control the creation of fuel reserves during the preparation of power plants and boiler houses of all purposes for operation in the autumn winter period(hereinafter - OZP).

7. At power plants operating in the unified power system, the NNCT takes into account the need to supply power to non-switchable consumers powered by power plant feeders and not having backup power from the unified power system.

8. The consumption of electricity for the power plant's own needs, as well as for the power supply of consumers, with the exception of non-switched-off ones, is not taken into account by the calculation of NNCT, since in this case, power can be provided from a single power system for the period the power plant reaches NNCT.

9. NNCT for power plants operating in isolation from the unified energy system includes fuel reserves for electrical and thermal auxiliary needs, as well as for heat and power supply of non-switched off consumers.

10. NNCT is established for a period of 3 years and is subject to adjustment in cases of changes in the composition of equipment, fuel structure, as well as the load of non-switched off consumers of electrical and thermal energy that do not have power from other sources.

11. NNCT for power plants of the electric power industry is determined in agreement with the organization that performs dispatching functions.

12. Calculation of NCV is made for each type of fuel separately.

13. NNZT for power plants and boiler houses burning coal and fuel oil must ensure the operation of thermal power plants (hereinafter referred to as TPPs) in survival mode for seven days, and for TPPs burning gas - three days.

14. The fuel included in the NEZT, accumulated by October 1 - the beginning of the AWP, is included in the consumption for the generation of electrical and thermal energy during the AWP in accordance with the energy and fuel balances for each power plant and boiler house.

15. Annual calculation of NEZT is made for each power plant and boiler house burning or having solid or liquid fuel (coal, fuel oil, peat, diesel fuel) as a reserve. Calculations are made on the key date - October 1 of the planned year, which characterizes the preparation for work in the OZP from October 1 to April 1 next year.

16. Calculations of NNZT and NEZT are made in accordance with this Procedure.

17. NNZT and NEZT for associations of power plants and boiler houses are defined as the total volumes, respectively, for all power plants and boiler houses included in the association.

18. Calculations of standards for the creation of fuel reserves on the key date (October 1 of the planned year) before their submission to the Ministry of Industry and Energy of Russia, as a rule, are considered:

For power plants and boiler houses of the electric power industry by the relevant associations of power plants and (or) boiler houses;

For organizations of housing and communal services (hereinafter referred to as housing and communal services) by the relevant structural divisions of the executive authorities of the constituent entities of the Russian Federation.

19. All results of calculations and substantiation of the coefficients adopted for determining the standards for fuel reserves at thermal power plants and boiler houses are presented in the form of an explanatory note on paper (broken into a separate book) and in electronic form: an explanatory note - in Word format, calculations and necessary for calculations initial information - in Excel format.

II. Features of the procedure for calculating standards for heat sources of municipalities

20. The annual NEZT requirement for each heat source is determined by type of fuel in accordance with the existing regulatory characteristics of the equipment.

22. NEZT and AZT are determined by the sum of the values ​​of all heating (industrial and heating) boiler houses included in the municipality.

23. ONZT and its components (excluding the state reserve) for each heat source or groups of heat sources of municipalities are determined by (for fuel consumption up to 150 t/h) and (for fuel consumption over 150 t/h). Daily fuel consumption is determined for the mode of the coldest month.

24. Standards for groups of heat sources of municipalities are determined taking into account the availability of basic fuel storage warehouses.

25. The minimum stocks of fuel in the warehouses of heat supply organizations of housing and communal services are: coal - 45, fuel oil 30-day requirement.

26. The development of standards is carried out taking into account schedules, routes, methods of fuel delivery and its laying in heat source warehouses or base warehouses in the amount of the standard fuel reserve before the start of the heating season.

III. Methodology for performing calculations of standards for the creation of fuel reserves
at thermal power plants and boiler houses of the electric power industry

27. Calculation of NCV is carried out for power plants and boiler houses on the basis of normative and technical documents on fuel use.

28. Calculation of NNCT for power plants and boiler houses is drawn up in the form of an explanatory note. The results of the calculation are drawn up separately, signed by the heads of these power plants or boiler houses (to this Procedure) and agreed upon by the head of the association that includes these power plants or boiler houses.

29. Explanatory note to the calculation of NNCT includes the following sections:

one). List of non-switchable external consumers of heat and electric energy and data on the minimum allowable loads. The heat load of power plants and boiler houses is not taken into account, which, according to the conditions of thermal networks, can be temporarily transferred to other power plants and boiler houses;

2). Rationale technological scheme and the composition of the equipment that ensures the operation of power plants and boiler houses in the "survival" mode;

3). Calculation of the minimum required thermal power for the own needs of power plants and boiler houses, as well as electric power for the own needs of power plants operating in isolation from the UES of Russia.

30. The annual calculation of NEZT for the planned year (from January 1 of the planned year to January 1 of the next year) is performed as of the control date of October 1 for individual power plants and boiler houses. The results of the NECT calculations are drawn up together with the results of the calculation of the ONCT according to the sample in accordance with this Procedure. An explanatory note is attached to the results of the NEZT calculations.

31. According to the features of the execution scheme annual calculation NEZT power plants and boiler houses are divided into three categories:

Standard (typical calculation scheme);

With limited (seasonal) terms of fuel delivery;

Those who had a critical level of fuel reserves in the previous year (less than 60% of the ONZT as of October 1).

32. The calculation basis for a standard group of power plants and boiler houses is taken as the average daily consumption of coal, fuel oil, peat, diesel fuel at power plants or boiler houses in January and April of the planned year, necessary to fulfill the production program for the generation of electric and thermal energy of the planned year, taking into account the average growth factor average daily fuel consumption in January and April for the last three years before the planned one. The calculation is performed according to the formula:

K cp - the coefficient of a possible delivery failure (takes into account the delivery conditions that are created depending on the situation on the fuel market, relationships with suppliers, transportation conditions and other factors that increase the transportation time), is taken in the range of 1.5 - 2.5;

T ln - the weighted average time of fuel transportation from different suppliers, is determined by the formula:

34. In cases of separate combustion (by queues or boiler plants) of coal from different deposits or non-interchangeable deposits, NECT is determined for each deposit. The total NERT for the power plant or boiler house is determined by summation.

35. NEZT as of October 1 for associations of power plants and (or) boiler houses or individual power plants and boiler houses with limited delivery times must ensure their operation from the end of one delivery period to the beginning of the next similar period with a safety factor Kz = 1.2, taking into account the possible under realistic conditions, a shift in the start time of fuel supplies to areas with limited delivery times.

36. NEZT for combining power plants and (or) boiler houses or individual power plants and boiler houses, which had a critical level of fuel reserves as of October 1 in the previous WZP, is increased by an accident rate (Cav) equal to 1.2 of the calculated values.

37. ONRT is calculated as the sum of NCRT and NERT. The results of the calculation are drawn up separately according to the model in accordance with this Regulation, signed by the heads of power plants and boiler houses and agreed upon by the head of the association that includes these power plants and (or) boiler houses.

38. In exceptional cases, it is possible to adjust the standards for fuel reserves in case of significant changes in the program for the generation of electrical and thermal energy or a change in the type of fuel. The procedure for changing the standards is similar to the initial approval in accordance with these Regulations.

In support of the claims, it is indicated that the prosecutor's office of the Kachugsky district, when supervising the implementation of the MOU Poloskovskaya NOSh of legislation aimed at providing life support for the living conditions of citizens living in the territory of the Kachugsky district, established that, in violation of the legislation of the Russian Federation, there is no 45- daily fuel supply.

The absence of the necessary operating fuel supply at the boiler house of the Poloskovskaya NOSh MOU destabilizes the operation of the boiler house and does not ensure the planned generation of heat energy, entails a significant violation of the rights and legitimate interests of persons visiting this institution. In addition, in the event of a sharp drop in air temperature, as well as a long-term setting of such a temperature, it can lead to defrosting of heating networks and a violation of the living conditions of minors visiting educational institution.

At the hearing, assistant prosecutor Dobrotina *.*. supported the claims of the District Attorney.

Representatives of the defendants MOU Poloskovskaya NOSH *.*. A. and the Administration of the municipality "Kachugsky district" *.*. V. did not appear at the hearing, they were duly notified.

After listening to the prosecutor, examining the materials of the case, the court comes to the following.

According to the Conclusion on checking the readiness of heating boiler houses for the upcoming heating season, carried out by the Irkutsk Territorial Department for Supervision of Electrical Installations and Electric Networks, it follows that on the Date there is a supply of fuel (wood) at the boiler house of the MOU Poloskovskaya NOSH for 10 days.

In accordance with clause 2.6.13 of the Decree of the Gosstroy of 23.09.2003. No. 170 "On the approval of the Rules and Regulations technical operation housing stock", during the summer period, repair work should be carried out at boiler houses, including a supply of fuel: solid - at the rate of 70% of the need for the heating season, liquid - not less than the average monthly supply.

According to the Procedure for Calculation and Validity of Standards for the Creation of Fuel Stocks at Thermal Power Plants and Boiler Houses, approved by Order of the Ministry of Energy of the Russian Federation dated 04.09.2008. No. 66 "On the organization in the Ministry of Energy of the Russian Federation of work on the approval of standards for the creation of fuel reserves at thermal power plants and boiler houses, the standard for the creation of fuel reserves at boiler houses is a general standard reserve and is determined by the sum of the volumes of the irreducible standard fuel reserve (hereinafter referred to as NRC) and the standard operational fuel reserve (NERT).

NNZT is created at boiler organizations to maintain positive temperatures at the boiler house and adjacent structures in the "survival" mode with a minimum heat load under the conditions of the coldest season.

NNZT at heating boiler houses is created in order to ensure their operation under unforeseen circumstances (interruptions in the supply of fuel; a sharp decrease in outdoor temperature) when it is impossible to use or when the standard operating fuel reserve (NEZT) is exhausted.

NEZT is necessary for the reliable and stable operation of boiler houses and ensures the planned generation of heat energy.

The number of days for which the NNCT is calculated is determined by the actual time required to deliver fuel from the supplier and the time required to loading operations.

To calculate the NEZT, the planned average daily fuel consumption of the three coldest months of the heating period and the number of days are taken: for solid fuel - 45 days; for liquid fuel - 30 days.

In accordance with Article 17 federal law“On the General Principles of the Organization of Local Self-Government in the Russian Federation”, local self-government bodies of municipal districts, have the authority to create municipal enterprises and institutions, financing of municipal institutions.

Giving an assessment of the actual circumstances of the case, investigated in the court session, the court comes to the conclusion that the requirements of the prosecutor are satisfied. Failure to comply with the requirements of the law may lead to adverse consequences in the form of emergencies at facilities, disruption of the normal life of minors attending an educational institution.

Based on the foregoing, guided by Articles 194,196-198 of the Code of Civil Procedure of the Russian Federation, the court

Satisfy the claims of the prosecutor of the Kachugsky district.

To oblige the municipal educational institution Poloskovskaya primary general education school to provide a standard operational supply of solid fuel for a boiler house for 45 days.

8. While maintaining all the initial conditions for the formation of NCVT for the second and third years of the three-year period, the power plant (boiler house) confirms the volume of NCVF included in the ONZT of the planned year, without submitting calculations.

9. During a three-year period, NNCT is subject to adjustment in cases of changes in the composition of equipment, fuel structure, as well as the load of non-switched consumers of electrical and thermal energy that are not powered by other sources.

10. NNCT for power plants of electric power industry organizations is determined in agreement with the relevant subject of operational dispatch control.

11. Calculation of NCV is made for power plants and boiler houses for each type of fuel separately.

12. NNCT for power plants and boiler houses burning coal, fuel oil and diesel fuel ensures the operation of thermal power plants in survival mode for seven days, and for thermal power plants and boiler houses burning gas - three days.

13. NNCT is restored in the approved amount after the termination of actions to maintain the "survival" mode of power plants and boiler organizations of the electric power industry, and for heating boilers - after the elimination of the consequences of unforeseen circumstances.

14. For gas-fired power plants and boiler houses, NNCT is set for reserve fuel.

15. NEZT is necessary for the reliable and stable operation of power plants and boiler houses and ensures the planned generation of electrical and (or) thermal energy.

16. Calculation of NEZT is made annually for each power plant and boiler house that burns or has solid or liquid fuel (coal, fuel oil, peat, diesel fuel) as a reserve. Calculations are made on October 1 of the planned year.

17. Calculations of NNZT and NEZT are made for power plants (boiler houses) of electric power industry organizations and heating (industrial and heating) boiler houses of organizations that are not related to electric power industry organizations, in accordance with this Instruction, respectively. In the results of calculations, the values ​​of the standards are presented in tons of natural solid and liquid fuels and are rounded up to tenths of the specified unit of measurement.

18. The Ministry of Energy of Russia annually, before June 1, considers the calculations of standards for the creation of fuel reserves submitted for October 1 of the planned year, agreed upon:

for power plants and boiler houses of the electric power industry organization - by the relevant generating companies;

for organizations operating heating (industrial and heating) boiler houses, as well as power plants and boiler houses in industries (with the exception of the organization of the electric power industry) - by bodies executive power Russian Federation and (or) local authorities.

19. The Ministry of Energy of Russia considers the submitted materials with calculations of the standards for the creation of fuel reserves, which contain:

1) justification and calculation of NNCT or its confirmation;

2) justification and calculation of NERT;

3) data on the actual main and reserve fuel, its characteristics and structure as of October 1 of the last reporting year;

4) methods and time of fuel delivery;

5) data on the capacity of storages for solid fuels and the volume of tanks for liquid fuels;

6) indicators of average daily fuel consumption in the coldest estimated time of the year of previous periods;

7) technological scheme and composition of equipment that ensure the operation of power plants (boiler houses) in the "survival" mode;

8) a list of non-switchable external consumers of heat and electricity;

9) the estimated heat load of external consumers (the heat load of power plants and boiler houses is not taken into account, which, according to the conditions of thermal networks, can be temporarily transferred to other power plants and boiler houses);

10) calculation of the minimum required heat load for the own needs of power plants (boiler houses), as well as electric power for the own needs of power plants operating in isolation from the UES of Russia;

11) justification of the accepted coefficients for determining the standards for fuel reserves at power plants (boiler houses);

12) the amount of ONRT, broken down into NNCT and NERT, approved for the previous planned year;

13) the actual use of fuel from OHCR with the allocation of NECT for the last reporting year.

20. Until October 1 of the year preceding the planned year, the general fuel reserve standards (ONZT) for power plants and boiler organizations of the electric power industry are approved by order of the Ministry of Energy of Russia.

In exceptional cases, it is possible to adjust the fuel reserve standards in case of significant changes in the program for the generation of electrical and thermal energy or a change in the type of fuel.

21. All results of calculations and substantiation of the coefficients adopted for determining the standards for fuel reserves at thermal power plants and boiler houses are drawn up in the form of an explanatory note on paper (broken into a separate book) and in electronic form.

II. Methodology for performing calculations of standards for the creation of fuel reserves at thermal power plants and boiler organizations of the electric power industry

22. NCVT based on the operation of the station in survival mode during the day is calculated for all types of fuel according to the formula:

23. The annual calculation of NEZT is carried out as of the key date October 1 of the planned year for power plants and boiler houses of the electric power industry. An explanatory note is attached to the results of the NEZT calculations.

24. According to the peculiarities of the scheme for performing the annual calculation of NEZT, power plants and boiler houses can be divided into:

standard (with the possibility of regular fuel supplies);

with limited (seasonal) terms of fuel delivery.

25. The basis for calculating the NECT for a standard group of power plants and boiler houses is the average daily consumption of coal, fuel oil, peat, diesel fuel in January and April of the planned year at power plants or boiler houses, necessary to fulfill the production program for the generation of electric and thermal energy of the planned year.

26. Calculation of NECT is performed according to the formula:

AT 1 , AT 2 , AT 3 - actual average daily fuel consumption in January and April for the first, second and third years preceding the planned year (in the absence of actual data for the year preceding the planned one, planned values ​​can be taken).

When calculating standards reserve fuel in cases where one of the values ​​of the average daily fuel consumption ( AT ETC, AT 1 , AT 2 , AT 3) has a zero or close to zero value in January and April, NEZT as of October 1 of the planned year is taken at the level of the highest standard value during the three years preceding the planned year.

To SR - coefficient of possible disruption of delivery (takes into account the delivery conditions that are created depending on the situation on the fuel market, relationships with suppliers, transportation conditions and other factors that increase the transportation time) is taken in the range of 1.5-3.5 (justification for the accepted value of the coefficient is given) ;

27. For existing thermal power plants and boiler houses, the calculation of NEZT is carried out without taking into account the non-recoverable ("dead") residue of fuel oil. For newly commissioned thermal power plants and boiler houses, as well as for additionally organized tanks at existing thermal power plants and boiler houses, the NEZT additionally, based on calculations (expert assessments), includes the amount of fuel that will go into the unrecoverable residue.

29. When natural gas is burned at a power plant or boiler house, the calculated value of NEZT of reserve fuel (coal or fuel oil) as of October 1 increases by a volume depending on the magnitude of a possible limitation of gas supply due to a sharp decrease in outdoor air temperature, if this volume does not exceed the working volume of fuel oil storage facilities. The calculation takes into account a 40% reduction in gas supply for 28 days - 14 days each in December and January. The volume of reserve fuel (coal or fuel oil) to replace the gas supply restriction is determined by equivalent coefficients ( To EKV), taking into account the calorific value of the fuel in relation to the conditionally reduced fuel with a calorific value of 7000 kcal/kg ( NERT ZAM).

30. In cases of separate combustion (by queues or boiler plants) of coal from different deposits or non-interchangeable deposits, the NEP is determined for each deposit. The total NECT for a power plant or boiler house is determined by summing coal by deposit.

31. NEZT on October 1 of the planned year for associations of power plants and (or) boiler houses or individual power plants and boiler houses with limited (seasonal) delivery periods, must ensure their operation for the entire period for which fuel is imported, with a safety factor ( To 3) within 1.2, taking into account the possible shift in the time of the start of fuel supplies to areas with a limited supply period due to objective conditions. The list of such power plants includes power plants that do not have defrosting devices when receiving freezing coals in winter.

32. ONRT is calculated as the sum of NCRT and NERT. The results of calculations for power plants and boiler organizations of the electric power industry are drawn up in the form in accordance with this Instruction.

III. Methodology for performing calculations of standards for creating fuel reserves for heating (industrial and heating) boiler houses

33. This section defines the procedure for performing calculations of standards for the creation of fuel reserves for heating (industrial and heating) boiler houses that provide district heating to consumers with a predominant heating and ventilation load and a load of hot water supply.

34. Standards for the creation of fuel reserves can be formed:

for the organization as a whole, with the possibility of using fuel reserves, regardless of the territorial location of sources of thermal energy and warehouses for storing fuel;

for individual separate subdivisions(branches) by type of fuel;

for separate divisions (branches), geographically remote from other divisions of the organization.

35. The standards for the creation of fuel reserves for organizations and (or) their separate subdivisions (branches) in areas where fuel delivery is seasonal are subject to separate calculation and justification.

In the standard for the creation of fuel reserves for specified organizations includes fuel that becomes the property of the heat supply organization at the time of its delivery.

36. Estimated amount of NNCT is determined by the average daily planned fuel consumption of the coldest month of the heating period and the number of days, determined taking into account the type of fuel and the method of its delivery:

37. The number of days for which the NNCT is calculated is determined by the actual time required for the delivery of fuel from the supplier or base warehouses, and the time required for loading and unloading operations (table 3.1).

38. For boiler houses operating on local types of fuel, NNCT is not established.

39. To calculate the amount of NEZT, the planned average daily fuel consumption of the three coldest months of the heating period and the number of days are taken:

for solid fuel - 45 days;

for liquid fuel - 30 days.

The calculation is made according to the formula 3.2.

40. For organizations operating gas-fired heating (industrial and heating) boiler houses with reserve fuel, the NEZT includes the amount of reserve fuel required to replace ( AT ZAM) gas fuel during periods of reduction of its supply by gas supply organizations.

Meaning AT ZAM is determined on the basis of data on the limitation of gas supply by gas supply organizations during the cold weather period established for the current year.

Taking into account deviations of actual data on restrictions from those reported by gas supply organizations for the current and two previous years, the value AT ZAM can be increased by their average value, but not more than 25 percent.

43. For organizations in which the production and transmission of thermal energy are not the main activities, the composition of the ONZT includes:

NNZT, calculated from the total heat load connected to the source;

NEZT, determined by the connected heat load of external consumers (subscribers, sub-subscribers).

44. Calculations of the standards for the creation of ONZT heating (industrial and heating) boiler houses are drawn up in the form in accordance with Appendix 3 to this Instruction.

In support of the claim, the plaintiff indicated that in the course of checking compliance with legislation aimed at ensuring favorable living conditions for the population, as of (... date ...) it was established that in .... municipality at boiler houses providing heat supply to residential buildings in the r.p. (... name ...), objects of social importance and other objects, there is no necessary fuel supply. According to the information of the Unified Dispatch Service of the region, the coal reserve amounted to .... tons at a daily consumption of .... tons, that is, a reserve for five days instead of the established minimum standard coal reserve for .... days, which ensures operation in survival mode. The specified minimum standard coal reserve is calculated based on the actual time required for the delivery of fuel from the supplier or base warehouses and the time required for loading operations. For a solid type of fuel, when fuel is delivered by rail, the amount of fuel stock should be for .... days, for delivery by road - for .... days.
  13. In r.p. (... name ...) coal is delivered both by rail and by car. According to the information of the defendant and the information of the administration of the Ust-Ilimsk region dated (...date...), the standard fuel supply should be .... tons, while the method of fuel delivery is not indicated. As of (...date...) the daily fuel consumption was.... tons with the actual stock of.... tons. The lack of a standard fuel reserve is explained by the presence of debts of OJSC "...." for previously delivered products. The lack of a supply of fuel necessary to ensure the uninterrupted operation of the boiler houses of the village leads to a violation of the rights of citizens living in the territory of the settlement to normal conditions activity in the winter, creates obstacles for citizens to exercise their rights to use energy and heat resources for domestic needs in unlimited quantities. The defendant's failure to take action is the result of inaction to comply with the requirements of the Federal Law “On Heat Supply”.

By the decision of the Ust-Ilimsk city court of the Irkutsk region dated February 16, 2012, the claims of the Ust-Ilimsk inter-district prosecutor, acting in the interests of an indefinite circle of persons, were partially satisfied. The defendant JSC "....", represented by the representative of S., acting on the basis of a power of attorney, also disagreed with the decision of the court and filed an appeal, in which he indicated that the decision was illegal, unreasonable and subject to cancellation, since the court incorrectly determined the circumstances of importance for the case, the conclusions of the court does not correspond to the actual circumstances of the case.
  19. Indicated that JSC "...." in r.p. (...name...) is an energy supply organization. JSC "...." complies with its obligation to ensure timely, uninterrupted preparation and supply of fuel to the boiler room within the framework of the Order dated (... date ...) No. .... "O....". This order is internal normative act and mandatory for all branches and structural divisions JSC "....". Work on the calculation and justification of the standards for the creation of fuel reserves at boiler houses is carried out in accordance with the provisions of the Instruction on the organization of work on the calculation and justification of the standards for the creation of fuel reserves at thermal power plants and boiler houses in the Ministry of Energy of Russia, approved by Order of the Ministry of Energy of the Russian Federation dated 04.09.2008 No. 66.
  20. The estimated size of the irreducible standard fuel reserve is determined by the average daily planned fuel consumption of the coldest month of the heating period and the number of days, determined taking into account the type of fuel and the method of its delivery. Based on the formula for calculating the irreducible standard fuel reserve, the NCV for the central boiler house is .... tons; for boiler room No. .... tons; for boiler room No. .... tons. Thus, the irreducible normative reserve of fuel upon delivery of it by rail is .... tons.
  21. It also indicated that, as follows from the requirements of the Instructions, the Regulations on the Ministry of Energy of the Russian Federation, the right to approve standard fuel reserves was granted to the Ministry of Energy of the Russian Federation. Local governments only agree on the standards for fuel reserves, which are then submitted for subsequent approval to the Ministry of Energy of the Russian Federation for consideration (clause 18 of the Instruction). He believes that due to the fact that the authorized body has not approved the standard fuel reserve in the prescribed manner, the Decision on the obligation of such a reserve cannot actually be enforced.
  22. Requests the Decision of the Ust-Ilimsk city court of the Irkutsk region dated February 16, 2012 to cancel and adopt a new Decision in the case.
  23. After hearing the report of the judge of the Irkutsk Regional Court Astafieva O.Yew., explanations of the defendant's representative by proxy Zhilkina E.A. supported the arguments of the appeal, having studied the case file, checking the legality and validity of the court decision in accordance with the Code of Civil Procedure of the Russian Federation on the arguments of the appeal, the appeal, the panel of judges finds no reason to cancel it.
  24. When considering this case, the court correctly identified the circumstances relevant to the resolution of the case, correctly applied the norms of substantive and procedural law, gave a proper assessment of all the evidence collected in the case in their entirety in accordance with the requirements of the Civil Procedure Code of the Russian Federation. In accordance with the Instruction on Organization in the Ministry of Energy of Russia, work on the calculation and justification of the standards for the creation of fuel reserves at thermal power plants and boiler houses, approved by the Ministry of Energy of the Russian Federation dated 04.09. is determined by the sum of the volumes of the irreducible standard fuel reserve (NNZT) and the standard operational fuel reserve (NEZT).
  25. An irreducible standard fuel supply at heating boiler houses is created in order to ensure their operation under unforeseen circumstances (interruptions in the supply of fuel; a sharp decrease in outdoor temperature, etc.) when it is impossible to use or the standard operating fuel supply is exhausted.
  26. The normative operating fuel reserve is necessary for the reliable and stable operation of power plants and boiler houses and ensures the planned generation of electrical and (or) thermal energy.
  27. The irreducible standard fuel supply for power plants and boiler houses burning coal, fuel oil and diesel fuel, regardless of ownership and organizational and legal forms, must ensure the operation of thermal power plants in survival mode for seven days.
  28. Standards for the creation of fuel reserves for organizations and (or) their separate subdivisions (branches) in areas where fuel delivery is seasonal, are subject to separate calculation and justification.
  29. The number of days for which the NNCT is calculated is determined by the actual time required to deliver fuel from the supplier or base warehouses, and the time required for loading and unloading operations.
  30. Resolving the dispute, the court found that the central boiler room, boiler room No. .... and boiler room No. .... use the type of fuel - coal. The method of fuel delivery to boiler house No. ...., boiler room No. .... is determined by road transport; to .... boiler room - by rail. Supply of coal for OJSC "...." is carried out by OJSC "....".
  31. According to the order dated (...date...) No. .... "....", an irreducible standard fuel (coal) reserve of at least .... days is established, based on the current fuel consumption in this period.
  32. According to the answer and.about. the head of the administration of the MO "...." from (... date ...) the minimum standard fuel reserve for .... OJSC "...." was determined in the amount of .... tons based on the volume of the stock for. ... days, the actual time required for the delivery of fuel from the supplier and the time for loading and unloading.
  33. In accordance with paragraphs 4, 7, 9, 12 of the Instruction, the minimum standard fuel reserve is calculated and justified once every three years, the results of the calculations are drawn up as of October 1 of the current year. An irreducible standard fuel supply at heating boiler houses is created in order to ensure their operation under unforeseen circumstances (interruptions in the supply of fuel; a sharp decrease in outdoor temperature, etc.) when it is impossible to use or the standard operating fuel supply is exhausted. During a three-year period, NNCT is subject to adjustment in cases of changes in the composition of equipment, the structure of the fuel, as well as the load of non-switched consumers of electrical and thermal energy that are not powered by other sources. NNCT for power plants and boiler houses burning coal, fuel oil and diesel fuel ensures the operation of thermal power plants in survival mode for seven days, and for thermal power plants and boiler houses burning gas - three days.
  34. Having assessed in aggregate the circumstances established in the case and applying the enumerated norms of law, the court reasonably came to the conclusion that general condition to establish an irreducible standard fuel supply is to provide boiler houses with fuel for .... days. In case of failures in the provision of NEZT in the Irkutsk region, it is recommended to install NNZT within .... days when delivered by rail, .... days - by road.
  35. Thus it is the court correctly came to the conclusion that for the boiler .... OJSC «....» irreducible standard fuel supply for the heating season (...date...) y.g. must be provided for .... days. Since the daily fuel consumption at boiler houses (depending on the outside temperature) is .... tons, the court reasonably concluded that the minimum standard fuel reserve at .... boiler house, boiler room No. .... and boiler room No. . ... during the heating season (... date ...) y.y. must be at least .... tons.
  36. The court also established and was not disputed by the parties that .... boiler room, boiler room No. .... and boiler room No. .... had an adequate supply of fuel for the heating season (... date ...) y.y.
  37. At the same time, as can be seen from daily operational information, the irreducible standard fuel reserve was unstable in some periods. Its volume was below the established .... tons. As of the date of consideration of the present case, NNCT amounted to .... a ton, which also does not meet the established standard.
  38. Under such circumstances, the court reasonably came to the conclusion that since the defendant did not comply with the volumes of the irreducible standard fuel supply, the claims of the Ust-Ilimsk interdistrict prosecutor, acting in the interests of an indefinite circle of persons, against JSC “....” on the obligation to provide the standard reserve of fuel during the heating season are partially subject to satisfaction - the minimum standard fuel supply at the boiler houses of JSC "...." during the heating season (... date ...). must be at least .... tons.
  39. The conclusions of the court, set out in the decision, are motivated in detail, based on the analysis current legislation and the materials of the case, there are no grounds for recognizing them as incorrect by the panel of judges.
  40. The arguments of the appeal that the minimum standard fuel supply for boiler houses when delivered by rail should be .... tons, the panel of judges cannot be taken into account, since these arguments were the subject of legal proceedings and were reasonably rejected for the reasons specified in the court decision .
  41. Other arguments of the appeal are aimed at a different, incorrect interpretation of the substantive law and the assessment of evidence about the circumstances established and examined by the court in full accordance with the rules
