Let's turn to the Labor Code. By virtue of Part 1 of Art. 197 employees have the right to undergo an independent qualification assessment. According to Part 1 of Art. 196 the need to send employees for such an assessment for their own needs is determined by the employer. That is, the applicant can apply to the CSC for an independent assessment on their own, or can be sent by the employer.

The Ministry of Labor answers the question as follows: qualification assessment is voluntary for both employees and employers and does not entail any mandatory consequences or requirements.

If an employee is sent to undergo an independent qualification assessment at the initiative of the employer, the employee must be asked for written consent. At the same time, the employer must provide them with certain guarantees and compensations for the period of the assessment by employees. In particular, in accordance with Art. 187 of the Labor Code of the Russian Federation:

    payment for passing such an assessment is carried out at the expense of the employer;

    the employee retains the place of work (position) and the average salary at the main place of work;

    if an independent assessment is carried out in another location, the employee is paid travel expenses in the manner and amount that are provided for persons sent on business trips.

What is the validity period of the results of the independent evaluation?

2. In the direction of the employer - at the expense of his funds.

Payment for services is carried out on the basis of an agreement concluded between the person at whose expense the professional examination is held and the CSC on the provision of services for a fee. How are the results of the independent evaluation applied?

As the Ministry of Labor has already noted, qualification assessment is voluntary and does not entail any mandatory consequences or requirements.

In particular, the employer will not be able to dismiss an employee on the basis of unsatisfactory results when passing an exam (unlike the certification provided for in Article 81 of the Labor Code of the Russian Federation).

About the creation of the CSC

According to Law No. 238-FZ and Order of the Ministry of Labor of the Russian Federation of November 1, 2016 No. 601n “On Approval of the Regulations on the Development of Evaluation Tools for Independent Qualification Assessment”, evaluation tools are a set of tasks, evaluation criteria used by the CSC when conducting a professional exam for compliance with the qualifications of an applicant the provisions of the professional standard or qualification requirements established by federal laws and other regulatory legal acts of the Russian Federation. Summing up what the Ministry of Labor has said, it can be noted once again that an independent assessment is a voluntary event. So far, no one can force either employers or employees to conduct (pass) it. And even if it was carried out, then it will not work to use the results of the assessment in order to confirm the compliance of the employee with the position held and his dismissal.

However, the stakes for this procedure are high. Officials are sure that passing the qualification assessment will simplify the process of employment and that the employees themselves will be interested in maintaining a high level of their knowledge, skills, etc. throughout their working life. And first of all, organizations that require professional standards and public sector institutions will begin to conduct an independent assessment.

During the transition period, until 2019, most likely, changes and additions will still be made to regulatory framework, to approve new professional standards and create new CSCs, since at the moment there are clearly not enough of them.

1. These Rules establish the procedure for conducting an independent assessment of qualifications by the qualification assessment center in the form of a professional exam.

2. The terms used in these Rules mean the following:

"assessment tools for conducting an independent assessment of qualifications" - a set of tasks, assessment criteria used by centers for assessing qualifications when conducting a professional exam;

"Register of information on conducting an independent assessment of qualifications" - an information resource to ensure an independent assessment of qualifications;

"Council for Professional Qualifications" - a governing body vested in accordance with the Federal Law "On the Independent Assessment of Qualifications" with the authority to organize an independent assessment of qualifications for a certain type of professional activity;

"applicant" - an employee or a person applying for a certain type of labor activity who has applied, including through the direction of the employer, to the qualification assessment center to confirm their qualifications in the manner established by the Federal Law "On Independent Assessment of Qualifications" and these Rules;

3. A professional examination is conducted by a qualifications assessment center to confirm the compliance of the applicant's qualifications with the provisions professional standard or qualification requirements established by federal laws and other regulatory legal acts of the Russian Federation.

4. 5. A professional exam is conducted at the initiative of the applicant at the expense of the applicant, other individuals and (or) legal entities or at the direction of the employer at the expense of the employer in the manner prescribed by labor legislation.

6. The person at whose expense the professional examination is conducted (the applicant, employer, other individual and (or) legal entity) pays for the services of the professional examination on the basis of an agreement concluded between him and the center for assessing qualifications for the provision of services (hereinafter - agreement).

7. To pass a professional exam, the applicant personally or through a legal representative submits to the qualification assessment center on paper or electronic media a set of documents, including (hereinafter referred to as the set of documents of the applicant):

a) an application for a professional exam, indicating the qualification for which he wants to pass a professional exam, while in the application the applicant agrees to the processing of his personal data contained in the application, as well as in the documents and materials attached to it;

b) a copy of the passport or other identity document of the applicant;

c) other documents required for the applicant to pass a professional exam for the relevant qualification, information about which is contained in the register of information for an independent qualification assessment.

8. In order to ensure the conduct of a professional examination, the qualification assessment center shall:

a) acceptance and registration of a set of documents of the applicant;

b) consideration and informing the applicant or legal representative about the results of consideration of the set of documents of the applicant;

c) determination and agreement with the applicant or legal representative of the date, place and time of the professional examination;

d) conducting a professional examination;

e) registration of the results of the professional examination;

f) registration and issuance of a certificate of qualification to the applicant or legal representative (in the event that the applicant receives an unsatisfactory grade based on the results of passing a professional exam, registration and issuance to the applicant or legal representative of a conclusion on the passage of a professional exam by the applicant, including recommendations for the applicant).

9. Within 10 calendar days after receiving the set of documents of the applicant, the Qualifications Assessment Center informs the applicant or legal representative in the manner specified in the application for the professional examination about the results of consideration of the application and the set of documents of the applicant and agrees with the applicant or legal representative on the date, place and time conducting a professional examination, as well as informing the applicant or legal representative about the procedures for conducting a professional examination.

If a professional exam is conducted at the direction of the employer, the qualification assessment center agrees with the employer on the date, place and time of the professional exam.

If an applicant or legal representative submits an incomplete set of applicant documents, the Qualification Assessment Center informs the applicant or legal representative about this.

10. The applicant is allowed to pass a professional exam on the basis of an identity document.

11. Conducting a professional examination is carried out in accordance with the assessment tools for conducting an independent assessment of qualifications for the relevant qualification, approved by the Council for Professional Qualifications.

12. When conducting a professional exam, representatives of the Ministry of Labor and Social Protection of the Russian Federation, the Council for Professional Qualifications have the right to be present.

13. An applicant who does not appear for a professional exam is allowed to take a professional exam in the cases and under the conditions stipulated by the contract.

14. A professional exam is considered successfully passed if the applicant achieves a result that meets the assessment criteria determined by the assessment tools for an independent assessment of qualifications.

15. The results of the professional exam are documented in the protocol of the expert commission (hereinafter referred to as the protocol).

The Qualification Assessment Center no later than 7 calendar days after the completion of the professional exam sends the protocol, copies of the sets of documents of the applicant and other materials of the professional exam to the council for professional qualifications.

16. Council for professional qualifications on the basis of the protocol, copies of sets of documents of the applicant, test results, photo and video materials and other materials of the professional exam no later than 14 calendar days after the completion of the professional exam:

a) checks, processes and recognizes the results of an independent qualification assessment;

b) makes a decision on issuing to the applicant or legal representative by the qualification assessment center a certificate of qualification or a conclusion on passing a professional exam;

c) directs to autonomous non-profit organization"National Agency for the Development of Qualifications" to enter information on qualification certificates and conclusions on passing a professional exam into the register of information on an independent assessment of qualifications.

17. Based on the decision of the council for professional qualifications, based on the results of the applicant's passing a professional exam, no later than 30 calendar days after the completion of the professional exam, the Qualification Assessment Center draws up and issues a certificate of qualification to the applicant or legal representative issues an opinion on passing a professional examination, including recommendations for the applicant) or sends a certificate of qualification (an opinion on passing a professional examination) to the address of the applicant indicated in the application for a professional examination.

18.
