All the noise began because of the order of the Ministry of Agriculture, which the participants of the dairy market accidentally found in the Garant database. After information about additional documentation was disseminated through the media from March 1, the Ministry of Agriculture clarified that, according to order N648 of December 18, 2015, registration of veterinary accompanying documents (VSD) for certain types of products, including packaged milk, is not required until 2018 of the year.

At the same time, the ministry noted that mandatory electronic veterinary certification of finished products, including milk, will be introduced only from January 1, 2018. Until that time, electronic veterinary certification can be carried out by companies at will.

Recall that on Wednesday it became known that the National Union of Milk Producers (Soyuzmoloko) appealed to the federal authorities with a request to withdraw the order of the Ministry of Agriculture of the Russian Federation, which obliges producers of drinking packaged milk to issue veterinary accompanying documents (VSD) for each party. The union noted that the Russian dairy market is not ready for such steps, the mandatory registration of the VSD can lead to a halt in many industries, as a result of which milk prices can rise significantly.

Putin's lightning reaction

The dairy theme immediately attracted attention, even the president reacted to this message. At a meeting with the head of the Ministry of Agriculture, Alexander Tkachev, Vladimir Putin made it clear that a rise in milk prices is undesirable.

“It is important that all these innovations be minimally bureaucratic and that they do not create an additional significant burden for producers, which in the end will inevitably affect the price of the product,” the head of state said.

The head of the Ministry of Agriculture of the Russian Federation, in turn, noted that Russia is adopting foreign experience. Now there is a lot of “counterfeit and counterfeit, and smuggling” on the Russian market, in order to understand the place of origin and movement of goods, electronic certification is being introduced. Those who oppose simply want to "cash in on it," said Alexander Tkachev.

The same idea was voiced by the head of the State Duma Committee on Agrarian Issues, Nikolai Pankov, saying that dairy producers who oppose electronic certification simply do not want to make the production scheme transparent and open.

There will be no costs

It is worth noting that electronic certification is already in effect for milk producers. Now the Ministry of Agriculture wants to transfer this experience to milk processors. Tamara Kasyanova, managing partner of JSC 2K, told what exactly the ministry is trying to do.

- Now milk sellers are already receiving veterinary certificates - this is a mandatory procedure for them. From March 1, they must receive them electronically. Producers of finished products, as conceived by the Ministry of Agriculture, should collect this data in their database when purchasing milk, draw up a generalized document and send it as a request for obtaining their certificate. That is, one batch of milk can have several suppliers who will provide all the necessary veterinary certificates in electronic form. The task of the buyer (manufacturer of finished products) is to collect all this data and send a request for his own - one veterinary certificate, - the expert explained.

According to her, if the veterinary certification system works in electronic mode, as planned, then milk producers should not incur any special additional costs.

Attracting additional labor resources to the registration of applications for obtaining a certificate of additional labor resources will not be large-scale if all data, including veterinary certificates directly from the dairymen themselves, from whom milk is purchased, will come in electronic form, she explained.

It will not require financial costs, the expert is sure.

If the process of obtaining a veterinary certificate itself is fully automated and obtaining a document is free, it will not be costly for dairy producers. Only funds will be needed for the development and implementation of an electronic certification system, Tamara Kasyanova noted.

Prices will rise by 5-10%

The National Union of Milk Producers, from which this whole story began, does not renounce their previous statements.

As Maria Zhebit, director of the public relations department of Soyuzmoloko, told us, “neither small nor large plants are ready to issue veterinary certificates.” The obligatory introduction of the VSD will inevitably lead to an increase in the cost of output and, in the final analysis, will be reflected in selling and consumer prices. And it does not matter what kind of certification we are talking about - electronic or non-electronic.

Many processors will have to hire a special person, and large processors will have to hire several dozen employees to deal with the issuance of these certificates. According to various factories and companies, this can increase the cost of production by 1-1.5%, and sometimes even more. For example, there are calculations for a plant with a processing capacity of 200 tons per day. In a year, it will take him almost 10 million rubles to introduce electronic certification, which will increase the cost of production by 5%, the expert said.

In the case of veterinary certification for processors "the old fashioned way" will need more than 25 thousand people, because each major processor will have to issue more than 6 million certificates annually. This will cost a large processor 8 billion rubles, which will increase the cost by about 7%. The costs of the entire dairy industry in connection with the paper-based veterinary certification can be estimated at 30 billion rubles. This applies to veterinary certification for all finished products, - added the director of the public relations department.

The fine for violations, according to Soyuzmoloko, will be up to 1 million rubles for each case. All these measures will eventually lead, according to the union, to an increase in milk prices by 5 to 10%. But there are also "sharper estimates," the expert added. According to Maria Zhebit, "all this is contrary to international practice, in the countries of the Customs Union there is no VSD for finished products either." At the same time, according to Soyuzmoloko, no discussion was held with the business community.

We believe that when it comes to such serious documents, it is necessary to meet with businesses, request calculations in order to assess the impact on the sector, on the wallets of citizens. Orders of this kind are not accepted so hastily, - said the representative of the union.

Despite official claims that there is no problem, some Russian dairy producers are already facing difficulties due to veterinary supporting documents. There were cases when retail chains refused to accept goods without the corresponding order of the VVD.

Several large producers have already received notifications from retail chains that the acceptance of products has been suspended and milk will no longer be supplied without veterinary accompanying documents, - said Maria Zhebit.

Growth will still

According to the representative of the distribution company, Development Director of Volgograd Dairy Products LLC Nikolay Lukyanenko, the panic that has gripped milk producers today is somewhat premature.

Until then, the submission of additional documents is voluntary and can be done electronically. The second point is that responsibility for the execution of the order is not spelled out either in it itself or in the acts to which it refers, he noted.

However, the distributor acknowledges that all these measures will affect prices, and gives some figures for the Volgograd region.

At each enterprise, which is not even engaged in production, but in the sale of a finished product, it will be necessary to create a department of two or three people who will deal only with the preparation of veterinary certificates. Each batch of goods of any size, starting from one pack, will have to have such a certificate. A conditional distributor issues 150-200 waybills per day. Accordingly, 150-200 references will be added to them. For enterprises of the Volgograd region, each certificate costs 54 rubles if the product is sold in the region, and 123 if outside. Partners still find it difficult to assess the total costs, - a company representative said.

In general, according to Nikolai Lukyanenko, the initiative of the Ministry of Agriculture to introduce veterinary control for the finished product is not entirely clear.

Rospotrebnadzor is already successfully carrying out control functions in this area. The initiative will not lead to anything but a rise in the cost of the product for the end user, - the distributor summed up.

On January 1, 2018, a system of mandatory electronic veterinary certification is put into effect. Electronic veterinary certification "Mercury": who applies

Organizations and individual entrepreneurs that are engaged in the production, transportation and trade of controlled products will be required to issue electronic veterinary accompanying documents (VSD).

  • During the production of each batch of controlled goods.
  • When moving (transporting) controlled goods. Since 2018, a separate certificate is required for each batch of transported products. And if there are several batches of goods in the container at once, each item will require its own VSD. In this case, a batch means a separate article (name) of a product with a separate expiration date.
  • When selling goods. This applies to cases of resale of products for the purpose of further sale. When selling products to the end buyer, if there is no movement of goods, for example, from store to store, electronic documents will not be required.

Thus, the system of electronic veterinary certification covers the entire cycle of production of products of animal origin - from raw materials to finished food products on store shelves. At each stage, you will need to obtain an appropriate accompanying veterinary document (certificate, veterinary certificate, veterinary certificate).

Who does not need e-Veterinary Certification?

Registration of electronic VSD is not required:

  • Catering enterprises to feed people at this enterprise (for example, these are canteens, cafes, restaurants), or if they sell goods to the end consumer to feed him in any other place. From January 1, 2018, paper veterinary certificates and certificates are being replaced by electronic ones, which can be issued online through the federal state information system "Mercury".

In order to be able to work with controlled goods, organizations and individual entrepreneurs must register with the FSIS "Mercury". The procedure for connecting to the system is established by Order of the Ministry of Agriculture of the Russian Federation of December 27, 2016 No. 589.

In order to register, you must send an application for access to the FSIS. An application can be submitted in the following ways:

  • in writing to the FSIS operator, that is, to the Rosselkhoznadzor or its territorial office;
  • in the form of an electronic document signed with an electronic signature.

An IP application must contain access rights to the FSIS service functions that the IP plans to receive, as well as data from the IP registration certificate. At the request of the individual entrepreneur, he can provide data on his veterinary education. Registration is made within 5 working days after receipt of the application.

After registration, authorized persons of the organization and individual entrepreneur are provided with:

  • password and login to enter the FSIS;
  • personal electronic account in FSIS;
  • e-mail address in FSIS;
  • the ability to issue electronic certificates and certificates;
  • the ability to cancel electronic certificates and references;
  • read access to FSIS data;
  • access to enter data into FSIS;
  • access to other opportunities of FSIS, according to the application.

Registered users are provided with appropriate statuses and access rights, such as "certified specialist", "authorized applicant", "authorized person", "administrator", etc.

Each status has its own set of opportunities that can be implemented through the FSIS. For example, only users with the access rights “authorized applicant”, “issuance of return certificates”, “authorized person”, “certification of FBR catches” and “certified specialist” can apply for a certificate.

How the new certification system will work

Certificates are issued on the basis of an application. The application must include the following information:

  • data on controlled goods;
  • the purpose of issuing a certificate (registration of a production batch, sale, or transfer);
  • data on the vehicle used for movement;
  • data on the place of departure and destination, as well as the conditions of transportation.

An application for an electronic certificate is considered by the FSIS in automatic mode within 1 hour from the moment it is issued.

The term for registration and issuance of electronic certificates cannot exceed one business day. This is a general rule.

If it is necessary to conduct laboratory tests, inspection and veterinary and sanitary examination of controlled goods, the period is extended. In these cases, an electronic document is issued within one working day after receiving the results of the relevant procedure.

In this case, the decision to send products for laboratory research must be justified in writing.

According to the new rules, inspectors will not be entitled to require manufacturers, carriers, suppliers and sellers to provide paper certificates.

At the same time, manufacturers, carriers and suppliers who have received electronic certificates have the right to demand that the document be duplicated on a secure form. Such a paper document is not required to be received/presented, and serves solely for the convenience of the manufacturer/supplier/carrier. A paper duplicate is provided only at the request of the applicant.

In this case, as a general rule, to confirm the certification, it will be enough to provide the number of the electronic VSD or present a bar code generated by Mercury. You can also submit a printout of an electronic document. Any option is acceptable and sufficient to confirm the fact of certification.

Electronic certificates will be valid from the moment they are issued until the expiration date / end of transportation / sale. When issuing certificates for animals, they are valid for 5 days before the date of transportation and until the end of the transportation / sale of animals.

Electronic VSD are stored for 3 years, but not less than until the expiration date of the regulated product. Electronic certificates are stored by Mercury itself. When duplicating a document on paper, the completed spine of the document is kept by the person who issued the certificate, and the certificate itself is kept by the purchaser of the controlled product for 3 years after the purchase of this product.

Data exchange with FSIS "Mercury" via 1C

This option allows you to automate the generation of electronic veterinary certificates. This significantly speeds up the acceptance and shipment of controlled goods and raw materials, which facilitates the work of both authorized employees of enterprises and veterinarians.

Rosselkhoznadzor refers to 14 more regions as outsiders, and places the rest in the middle of the list.

At the same time, the meat and fish industries can switch to new technologies even tomorrow, while problems remain in the production of milk and dairy products.

According to the amendments that have passed the second reading, it will be possible to issue veterinary documents on paper after July 1, 2018, but only in some cases. For example, if a catastrophe, a natural disaster, and so on, occurred in the region, which would make it impossible to use the federal state information system "Mercury". Or if in the area where the enterprise is located, there is no Internet access at all. In addition, there are restrictions on information that contains state or official secrets.

“Most likely, we will have to make some adjustments to our plans, but during the time that we are pushing through the introduction of the new system, we have already got used to it,” said Yulia Melano, an official representative of the Rosselkhoznadzor, in an interview with Rossiyskaya Gazeta.

The Mercury system being introduced has many advantages, but there are also difficulties in its implementation, Marina Petrova, CEO of Petrova Five Consulting, explained to RG. They are related to the fact that medium and small enterprises do not yet have the necessary competence, financial and human resources for the full implementation of automation. There is also a general misunderstanding of how to work with the new system.

In her opinion, to postpone the introduction of the EMU to July 1, 2018 and make it not permissive, but informational, would be the most reasonable decision. At the same time, she agrees that the idea itself is undoubtedly progressive. It will increase transparency in the market and introduce traceability of milk "from field to counter". In addition, it will show which enterprises and in what quantities use powdered milk, it will clarify how the flow of raw materials between regions is going on. And it will be clear exactly how much milk goes for processing from private farms.

The main feature of the system is that it is based on a process approach, without entering information at the input it is impossible to issue a veterinary accompanying document (VSD) for sale or movement in the system and remove the controlled product from the system at the end of the product’s life.
The entrance to the "Mercury" system is the input of information about the production batch for domestic products, for imports - the presence of a veterinary certificate issued in the "Mercury" system. So, each subsequent VSD is drawn up on the basis of the previous one, thus building a chain along which you can track the full path of movement of goods from the moment of production (import) to the end point (retail outlet, or disposal).
From March 01, 2015, it will be possible to issue veterinary and accompanying documents in electronic form, but there is no regulatory document that would oblige manufacturers of products subject to state veterinary supervision to put a barcode on the packaging, although now they can do it at will.

- Sergey Vladimirovich, what products fall under veterinary control and who carries it out?

All products of animal origin fall under the scope of veterinary control: fish, meat, milk, honey, cheese, etc. The system of state veterinary control consists of the Rosselkhoznadzor, veterinary services of the subjects of Russia, as well as veterinary services in each power ministry. Rosselkhoznadzor exercises control at the state border and in seaports, and the subject services, subordinate to the governor of the region, are already working on the ground. They interact with the Ministry of Agriculture through a complex system of regulations and reporting, and among themselves - solely on the basis of goodwill. The work of the veterinary services of the Ministry of Defense, the Federal Penitentiary Service, the FSO, the FSB and the Ministry of Internal Affairs is generally a secret with seven seals. In general, there are 91 self-sufficient decision-making centers for veterinary control.

- How is veterinary control carried out today?

Unfortunately, control today is fragmentary and does not meet modern economic conditions. Much of the blame for this lies with the outdated veterinary certification system. Certification today is a visual inspection of products, verification of documents, organoleptic examination, which allows in general to confirm: the products are obtained from fish or animals that are safe in veterinary and sanitary terms and are suitable for human consumption. Based on the results of the examination, the veterinarian issues an appropriate document - a veterinary certificate. If necessary, product samples are sent for laboratory testing.
The problem is that the subjective approach on the part of veterinarians and the lack of a unified system for recording legally significant actions with products have distorted the very essence of veterinary certification - traceability from the place of origin and confirmation of its safety. Today, most often these pieces of paper are issued as if on a conveyor, based on a set of other documents, and the procedure for real verification is absent in many places: there is not enough strength, time, or resources for it. And if they want, they can, and vice versa, instead of a conveyor, arrange a thorough inspection of the entire batch and, with each shipment, will certainly require laboratory tests. Naturally, everything is at the expense of the owner of the cargo. "Selective approach" - so you can characterize the system as a whole.

"There were no comments from public organizations regarding the execution of veterinary accompanying documents for milk and dairy products," the press release says.

"The order fully complies with the law," said Vladimir Borovoy, director of the veterinary department of the Russian Ministry of Agriculture.

The need for this clarification arose due to the fact that Soyuzmoloko sent a letter to Deputy Prime Minister of the Russian Federation Arkady Dvorkovich, State Secretary-Deputy Minister of Economic Development Oleg Fomichev and Head of the Presidential Administration Sergei Ivanov, in which, in his opinion, for unknown reasons, in the list of products, for which you need to issue veterinary certificates,. Nikolai Vlasov, deputy head of Rosselkhoznadzor, called untenable statements about the high costs that the industry may incur in connection with this innovation. "It is a misconception that certification will require large human and financial costs. We have an information gateway in the Mercury system for information exchange, it will only be necessary to "make friends" with the systems operating at enterprises," he said. human participation."

He also confirmed that the order of the Ministry of Agriculture does not provide for the introduction of certification of finished dairy products from March 1. "The order was misread, it only refers to the list of products that are subject to electronic veterinary certification or will be subject to it from January 1, 2018," Vlasov said.

According to him, it is until January 1, 2018 that the deadline for the start of veterinary certification of finished dairy products, including drinking milk, has been postponed. "Vet certification of these products can only be carried out on a voluntary basis - and many manufacturers are already doing this," he said.

According to the Rosselkhoznadzor, in 2015 almost 39,000 electronic veterinary certificates were issued for raw milk, and almost 88,000 of these documents for finished dairy products.
