What is Social Housing?

Many people, due to certain circumstances, are faced with such a concept as social housing rental. Most of them do not fully understand what it is and what its nuances are.

And some confuse it with such concepts as rent, privatization or ownership. But this concept cannot be attributed to any of them. It is difficult to understand for a person who does not have legal knowledge, but this issue can be sorted out if we consider all aspects of the contract of employment itself.

Such an agreement, like any other agreement, is concluded between two parties.

In this case, between socially unprotected segments of the population who are citizens of Russia and government agencies. The housing stock of Russia often acts as such a structure. It may be municipal or regional. Compliance with this type of agreement occurs on the basis of the LCD of Russia.

Under such an agreement, applicants receive a dwelling for use without a period of time (Article 60 of the RF LC) and have the right to receive all the "amenities" necessary for life associated with it.

These amenities include:

  • living in the premises
  • electricity,
  • water (hot and cold)
  • heating (according to established standards),
  • gas (if provided by the design features of the building),
  • repair and cleaning of the common area (corridors, entrances, stairs),
  • all communications (elevators, sewers, etc.)
  • and others.

At the same time, he undertakes to comply with all the requirements specified in this agreement.

First of all, the very concept of such housing should be defined. This is a living space that is transferred to certain categories of people who have Russian citizenship who need to improve their living conditions or do not have such housing in such a lease or property.

The role of such housing can be private houses, apartments, rooms, etc. The main condition is its suitability for living. The norms for this are spelled out in the LCD of Russia. In addition, it must meet the conditions for a minimum area for each person in the family (at least 7.5 square meters for each).

Who is eligible for social housing?

Not all citizens of Russia can receive such housing, but only certain people who meet the conditions for concluding this agreement. All citizens belonging to such a group are spelled out in Art. 49 LCD of Russia. And all the necessary requirements for recognizing people in need of improving their living conditions or obtaining housing under a contract are approved in Art. 51 LCD of Russia.

These groups of citizens include:


The last three groups of citizens may be entitled to receive living space under such an agreement, regardless of the queue.

And the conditions for recognizing poor people as in need of better living conditions are as follows:

  • If a person or members of his family do not rent housing under a similar agreement already concluded with the state.
  • If a person or members of his seven are still tenants of such housing, but it has an area smaller than that established by the norms. Most often this is due to the appearance of a new family member (adoption, birth). Then, in the recalculation of the area for each person required according to the standards, sq. meters may not be enough.
  • They live in residential premises that do not meet all the living standards described in the Russian Housing Code.

The following special categories of citizens can also apply for housing from the state fund:

  • veterans of the Great Patriotic War,
  • people left homeless due to disasters and natural disasters,
  • military personnel who have received injuries or injuries in the course of their service,
  • liquidators of the consequences of the accident at the Chernobyl nuclear power plant, who received disability as a result,
  • people belonging to groups I and II of disability.

Terms of receipt

In order to register and receive public housing, the applicant must have all the necessary documents certifying that they belong to the category of people who are entitled to receive such housing.

How to get social housing?

In order to obtain public rental housing, a person must provide the entire package of necessary documents and certificates to the local administration and submit an application.

After consideration of this application and all documents, a decision is made in writing as to whether the citizen can apply for public housing.

This decision subsequently becomes the basis for concluding an appropriate housing agreement with a citizen and registering it.

Refusal to register may occur when it is provided for by the laws of Russia.

Such cases may include:

  • Providing an incomplete package of documents required for registration.
  • Indication of unreliable or irrelevant information at the time of application submission.
  • Intentional worsening of living conditions in order to obtain social living space.

If the decision on registration is positively approved for a citizen, then he has the right to be registered until he receives the coveted social square meters or removes him from the register. It can be deregistered only in cases stipulated by the legislation of Russia.

All unreasonable refusals to register or deregister can be appealed by a citizen to the relevant state structures in a general manner.

What documents are required?

In order to register and receive the long-awaited square meters of social living space, the following documents are required:

Service housing for social hire

Service living space is provided to persons who carry out military service under a contract or are in the public service. After the expiration of the agreement or contract with the citizen, the office dwelling, by a court decision, is returned to the use of the owner (the state).

If there are minor children in the family of the employer, then she receives financial compensation in the amount of 30 - 40% of the cost of housing.

In the case of filing documents certifying that the family is poor and submitting the relevant documents to the municipality, service housing can be transferred to the category of municipal housing and issued under a social contract of employment.

Rights and obligations of the parties under the contract of social employment

When concluding such an agreement on hiring housing, it prescribes the rights and obligations of both parties.

Rights of the hiring party (citizen):

  • rent to third parties
  • to move persons who are not members of the family into the premises,
  • require the landlord to fulfill his obligations,
  • change to another home
  • register.

Responsibilities of the hiring party (citizen):

  • timely and full payment for the used premises,
  • maintaining the condition of the home,
  • ensuring the safety of housing and municipal property in it,
  • performing the necessary maintenance,
  • use of housing only for its intended purpose.

Rights of the landlord (state):

  • receiving rent (if applicable),
  • demand timely payment by the tenant of utilities in full.

Obligations of the landlord (state):

  • transfer to the tenant of the premises, free from claims to him by other persons,
  • ensuring and monitoring the proper provision of public utility services,
  • performing major repairs,
  • assistance in maintaining housing in good condition.

Social rent payment

All people living in the premises under such an agreement are required to pay for it.

This payment includes:

  • Payment for utilities used by tenants.
  • Payment for the services provided by the relevant management company, maintenance and repair of housing.
  • Rent. It is not charged only to low-income employers.

Privatization of housing under a social contract

In the process of privatization, the ownership of housing is transferred from the state to the tenant. It is voluntary and is carried out at the request of the employer. Thus, after the implementation of this procedure, a citizen becomes a full-fledged owner of housing and can dispose of it at his own discretion (rent, sell, rewrite as an inheritance, donate, and so on).

In order to carry out the privatization of such housing, the following documents must be submitted:

  • passport,
  • documents for the premises from the BTI,
  • social contract,
  • an application for privatization and the consent of all residents of the premises.
