Terms of issue of the document

The law provides that the longest stay of a citizen of a foreign state in the Russian Federation is possible within 90 days. In cases where a citizen of a foreign state has a student card, which is proof of his education at an educational institution in Russia, the time of his stay in the country is increased to 12 months. As for Russian citizens temporarily staying in another city or region of the country, the terms for registering their stay in this place are established by agreement between the owner of the housing and the visitor. However, in this case, the maximum period of validity of the registration certificate is also provided, which is 5 years.
Punishment for the absence of this document
According to the current legislation of the Russian Federation, if a citizen who is in a territory other than permanent residence does not have registration, he is punished. As a rule, this is a fine, the minimum amount of which is two thousand rubles, and the maximum is five. If we are talking about staying in Moscow or St. Petersburg, the penalty will be from five to seven thousand rubles.
For the lack of temporary registration, the owner of the housing, on the area of which a foreign or non-resident citizen lives, will also be punished. Citizens of foreign states staying in the Russian Federation without temporary registration may also be expelled from the country. In this case, a measure of prohibition on further entry into the territory of Russia may follow.
Refusal to obtain a certificate of registration
It is also necessary to take into account that the FMS authorities may refuse to provide a document confirming temporary registration. The reasons for such an outcome of the case may be the following situations:
The amount of living space is not enough to accommodate one more person;
There is no consent to entry from a resident tenant who is not the owner of the apartment;
Children are discharged in poor conditions. In this case, the guardianship authorities deal with this issue;
Registration of a child under the age of majority is carried out without the consent of the owner of the living space.
You have the right to appeal against any action of the FMS employees, which will cause a refusal to issue the required document. This can be done by filing a complaint about the incorrect actions of employees with the prosecutor's office or by contacting the judicial authorities. When you receive a refusal to issue a certificate of registration, you must request it in writing, stating the reasons. The document must be signed by the person responsible for this work.
