How to conduct certification in a company is one of the least regulated issues in labor legislation. There are regulatory legal acts that regulate in detail the issues of attestation of certain categories of workers: civil servants, teachers, etc. If the organization does not fall under the scope of these documents, then one should be guided only by the norms of the Labor Code of the Russian Federation on attestation and local regulations specifying them.

In the Labor Code of the Russian Federation, failure to pass certification is mentioned in paragraph 3 of part 1 of Art. 81 as grounds for dismissal. The same article states that the certification procedure is established by labor legislation and other regulatory legal acts, as well as local regulatory acts of the employer, adopted taking into account the opinion of the representative body of employees.

Based on Art. 82 of the Labor Code of the Russian Federation, a representative of the trade union should be included in the attestation commission if the results of the attestation serve as a basis for dismissal. Other references to attestation refer to the regulation of the labor of certain categories of workers (teachers, researchers, etc.).

Thus, the Labor Code of the Russian Federation regulates the process of organizing and conducting attestation in an ordinary company, where there are no special categories of workers and a trade union cell, extremely poorly. It is clear that certification should be carried out on the basis of a local regulatory act of the employer, but what and how to reflect in this document, how to conduct certification in practice - employers have to answer these questions on their own. In this article, we will consider controversial points that are worth considering before conducting certification.

1. What is certification for?

Certification should not be considered solely as one of the tools for dismissing an employee. Its task is to check the compliance of the employee with the position held, identify areas of development and unrealized potential of the employee. The process and results of certification in the company can be linked to the bonus system, career development and employee training program.

Organization of certification is a time-consuming and painstaking task. Therefore, it makes sense to use certification as a comprehensive tool for personnel management, and not just as a reason to fire someone.

2. How often to conduct certification?

The legislation establishes the frequency of attestation only for certain categories of employees. For example, certification of civil servants is carried out, certification of employees of internal affairs bodies -, certification of pedagogical workers, and even less often -.

How often should certification be carried out in a regular commercial organization? This question is at the discretion of the employer. But it hardly makes sense to do this more often than once a year: this is an adequate period for changes in the professional qualities of an employee, which will objectively be reflected in the results of the certification. The timing of certification may vary for different departments of the company. Where employees are constantly receiving, learning and applying new information, appraisals can be conducted more frequently than in other departments.

Thus, we can talk about the following types of certification:

  1. according to the criterion of planning, certification can be regular and extraordinary;
  2. according to the frequency of carrying out, it is possible to certify personnel one-time and constantly (periodically).

With the next certification, everything is quite clear: its terms are established by a local regulatory act, and a specific date can be set by order of the head.

And unscheduled certification should be carried out on a special occasion: following the results of advanced training, in connection with the introduction of new programs, instructions, technologies, etc. And here you need to understand that employees need objective time to master new information and acquire new skills. Therefore, it makes no sense to introduce a new program, and in a couple of days to carry out certification.

It is also legitimate to carry out extraordinary certification on negative grounds: in relation to employees who have been subjected to disciplinary sanctions for a certain period, or those against whom there are verified and confirmed complaints from clients, colleagues, etc.

In any case, unscheduled certification must be justified, especially if it is carried out selectively in relation to a particular employee.

It is possible to certify employees one-time. For example, a company introduces a system of grades (positional levels, etc.). To fairly place everyone on the steps, determine the position level and salary of each employee, you can use the appraisal tool. This will help to understand whether the employee corresponds to the level of his position and salary, whether these criteria should be shifted in relation to both the position and the specific employee.

Continuous certification is needed where employees continuously receive new information. In this case, the volume of knowledge to be tested may not be very large, and the certification procedure may be simplified. For example, call center employees receive updated information about customer services every month, must study it in two days and pass electronic testing.

3. What to include in the certification program?

The certification program should include questions that are directly related to the employee's job description, the requirements for his education and qualifications, established professional standards, as well as internal company documents that he must know. You should not, for example, ask a payroll accountant about the practice of tax litigation. Such questions the employee himself, as well as the inspectors and the court, on his complaint, may consider incorrect, and quite justifiably.

You can invite the employee to answer more complex questions that go beyond his position, but only if the employee claims to be promoted based on the results of certification and expresses such a desire himself.

In addition to answering questions, one should also evaluate the professional success or failure of the person being certified, reflecting this with an additional point. You can estimate the number of attracted customers, concluded contracts, inspected objects, events held, etc. A downgrade score can be set for the presence of disciplinary sanctions for a certain period.

4. Whom to include in the list of certified?

It makes no sense to carry out certification in relation to all without exception and is not always fair in relation to employees. For an objective certification, an employee needs a certain period of time to “enter the position”. That's why appraisal of long-term employees on a par with newly hired employees can be considered discrimination. It is necessary to establish a criterion for mandatory certification - work in a certain position, for example, at least a year. The rest of the employees can be allowed for certification only with their consent - if the employee is confident in his abilities and wants to demonstrate this to the management. Especially if the results of certification affect bonuses and career growth, you need to give beginners the right to participate in certification.

You can not unreasonably refuse an employee in certification. For example, when an employee is considered unsuitable for professional work in advance and is not included in the certification order because “everything is clear about him anyway”. This attitude may also be considered discrimination: you never know what management thinks, because certification is an objective tool for confirming qualifications, an employee has the right to participate in it on an equal basis with other colleagues. And in this case, the employee will be right.

There is categories of workers to whom labor legislation provides increased protection: pregnant women, persons under 18 years of age, persons with family obligations, etc. Although the Labor Code of the Russian Federation does not establish a ban on the participation of these categories of workers in certification, according to the general meaning of the Labor Code of the Russian Federation, they are subject to special protection, therefore we recommend that such workers be included in the list of those who are certified exclusively with their consent, and to involve in mandatory certification only in case of a change in their special status.

5. How to evaluate certified workers?

Attestation is a process in which an employee has the right to count on an objective assessment of his professional qualities. The objectivity of the assessment is ensured, firstly, by the competence of the members of the attestation commission, and secondly, by their impartiality.

Therefore, the commission should include persons who are fairly well versed in the issues on which certification is carried out. These can be not only experts and managers of the department in which the assessed employee works, but also representatives of related departments. For example, the head of the marketing department can be involved in the certification of sales managers, since the functions of sales and marketing are closely related and the salesperson must understand the essence of marketing.

The impartiality of the members of the commission it can be ensured that it includes persons to whom the certified person does not directly report (the head of the head of the department, a representative of a third-party organization - a client or supplier of the company). Necessarily conflict of interest should be avoided: an employee should not be evaluated by his relatives or a manager with whom there are disagreements.

Objectivity, as well as efficiency in assessing the results of attestation, can be ensured through IT technologies: develop computer tests, questionnaires, program automatic assessment of the results of attestation.

6. What to do after certification?

Since the results of the certification may affect the position of the employee in the company (bonus, promotion, transfer to another job in accordance with part 3 of article 81 of the Labor Code of the Russian Federation, dismissal), employees must be familiarized with the conclusions of the certification commission, without postponing it for more than a few days .

Employees are encouraged to provide the right to express their reasonable disagreement with the results of certification. The certification commission must consider the objections and send the employee for re-certification or recognize his objections as unfounded. Even if the employee goes on to complain to the GIT or to the court about an unfair assessment of his professional qualities, the company will already understand what the certified employee does not agree with.

What to do with employees not certified? These employees can be divided into two categories: those who can be fired based on the results of certification, and those whose dismissal on this basis is prohibited (Article 260 of the Labor Code of the Russian Federation).

You can part with employees from the first group only after offering them vacancies in the manner of Part 3 of Art. 81 of the Labor Code of the Russian Federation: it is necessary to offer vacancies in accordance with the qualifications of the employee or lower positions.

Employees who are not subject to dismissal based on the results of the appraisal should be advised to “finish their studies” to the required level and re-appraise. The same can be offered to “candidates for dismissal”: the employer is not obliged to dismiss employees who have not passed certification.

7. What if the employee did not come for certification?

What to do if the employee did not show up for certification without a good reason?

There are two options here. It is possible to carry out certification in the absence of the employee based on the available data (representation of the manager, data on the performance of the employee's duties, the opinion of the members of the commission, the results of the preliminary testing of the employee). This certification option should be provided for by a local regulatory act, as well as the possible consequences of a failure to appear - failure to pass certification. If the commission comes to the conclusion that the employee has not passed the certification, including due to his absence, he can be dismissed in accordance with paragraph 3 of part 1 of Art. 81 of the Labor Code of the Russian Federation, offering him available vacancies (part 3 of article 81 of the Labor Code of the Russian Federation). This kind of situation is described in the appeal ruling of the Moscow City Court dated December 20, 2013 in case No. 11-39131.

We note, however, that despite the existence of such a practice, we would not recommend such an option for dismissal for a commercial organization. Still, in the dispute considered by the courts, it was about the civil service, when attestation was mandatory. If, on the other hand, an ordinary company dismisses an employee for failing to appear for certification (namely, as one who did not pass certification due to a failure to appear), we believe that the courts may take the side of the employee.

If the certification commission comes to the conclusion that it makes no sense to carry out certification in the absence of an employee, or if such a certification method is not established by a local regulatory act, you can impose on the employee disciplinary action for evading certification. It is advisable to include in the attestation regulation and / or in the employment contract with employees a condition on their obligation to undergo attestation and / or include in the attestation order a clause stating that the employee is obliged to pass it at a certain date and time. Then the application of the penalty will be indisputable. After that, the employee can be again offered to undergo certification.

If the employee refuses to pass certification for the second time, then this will already give him a reason to fire in order n. 5 h. 1 Article. 81 of the Labor Code of the Russian Federation for repeated failure to fulfill their duties. We add that we did not find the practice of dismissal for failure to appear for certification, but we believe that such a situation is quite possible, especially if the employment contract and / or the certification provision contains a condition on the obligation to pass it and the employee is familiarized with this paragraph in writing (or signed in the order that he is obliged to come for certification on a certain date and time). This question is certainly debatable. And we must be prepared for the fact that the employer will have to defend his position in court.

2.1 I consider the purpose of my pedagogical activity to be the organization of training and education on the basis of personality development, the achievement of which I see in the individualization and differentiation of the educational process, through the introduction of modern educational technologies: student-centered, problem-based and developmental learning; technologies of critical thinking and information and communication technologies of education. Critical thinking is independent thinking, where the starting point is information. It starts with asking questions and is built on the basis of persuasive reasoning.

A feature of this pedagogical technology is that the student in the learning process constructs this process himself, based on real and specific goals, he himself tracks the direction of his development, he determines the final result. On the other hand, the use of this strategy is focused on developing the skills of thoughtful work with information, with text.

The perception of information occurs in three stages, which corresponds to the following stages of the lesson:

The perception of the new is the semantic stage (or the stage of the realization of the meaning);

The appropriation of information is the stage of reflection.

Lesson forms in the development of critical thinking differ from lessons in traditional teaching. The students do not sit passively, listening to the teacher, but become the protagonists of the lesson. The text is given a priority role: it is read, retelled, analyzed, transformed, interpreted, discussed, and finally composed.

Modern information and communication technologies are becoming one of the most important tools for school modernization. They facilitate the work of the teacher, make it possible to reduce the classroom load for students, diversify the forms and methods of learning, organize the learning process taking into account the personal characteristics of the student, and also track the specific results of education.

The use of digital educational resources (DER) in education requires the necessary technological support, so this approach must be combined with a technological approach aimed at the use of information and communication technologies.

In order to create appropriate conditions for teaching, developing and educating a student, a mathematics teacher, in turn, must have information and communication competence.

The use of information and communication technologies in education, and in the lessons of mathematics and computer science in particular, is impossible without a computer.

The basis for attestation for the qualification category indicated in the application is the following results of work that meet the requirements for the highest qualification category.

During the inter-certification period, the main direction of my activity was the creation of conditions aimed at the formation of moral and moral norms and rules in the pupils in the process of project activities.

To implement this direction, the following tasks were set:

Creation of pedagogical conditions for the accumulation of positive moral experience in children in the surrounding social and natural world;

Study and introduction into practice of new pedagogical technologies that contribute to the formation of general cultural values ​​in preschool children;

Improving the psychological and pedagogical competence of parents in the development of the moral qualities of the child's personality.

To implement the tasks, I created the following conditions: I developed a system and established a sequence of work on moral and patriotic education, a feature of which is an integrated approach to the formation of general cultural values ​​in preschool children. A large role is given to the creation of conditions, a variety of techniques and methods in working with children. Work in this direction began with the creation of a warm, cozy atmosphere for children. Every day a child in kindergarten should be filled with joy, smiles, good friends, and fun games. In the process of work, she enriched the developing subject-spatial environment in the direction of developing the moral qualities of the personality of each child. Designed the center "The world of nature, and we", which collected material on

social and moral education: a series of conversations with children on ethical topics, a “mirilok” card file, lepbooks on the topics: “Family”, “Defender of the Fatherland Day”, “A word about mother”, “Etiquette from an early age”, fiction on moral topics. Also presented is material on familiarizing children with the country, with their hometown: literature about Russia, Yekaterinburg, thematic folders containing photographs of the symbols of the country, our city and its attractions.

I use modern educational technologies productively. The application of the project technology made it possible to integrate educational areas and involve parents as much as possible in the activities of children, to establish close partnerships between all participants in the educational process. Together with the parents, within the framework of the project activities, family photo albums, albums “Traditions of our family” were made, various photo exhibitions were organized: “The best is MY DAD!”, “Our mothers are the most, the most!”, “Here it is, our summer !”, “My dearest!” and others. The whole complex of measures contributed to the accumulation of positive moral experience in children in the surrounding social and natural world.

The result of work in this area is the positive dynamics of the formation of general cultural values ​​among pupils. At the beginning of the implementation of the direction, monitoring revealed that the level of formation of general cultural values ​​in children prevails at a level below the average. Children experienced difficulties in many ways. According to the results of the monitoring conducted in the preschool educational institution, pupils have stable positive results in mastering the educational program of preschool education: the level of social and communicative development at the beginning of the 2015/2016 academic year was 38%, and at the end of the 2015/2016 academic year 59%, the level of cognitive development has increased from 34% to 53%, the level of artistic and aesthetic development - from 43% to 72%, the level of speech development - from 31% to 51%. In order to involve more parents and strengthen the relationship with the family, I used an innovative form of work - coaching sessions. Conducted consultations on the topics: "Project method - a tribute to fashion, or ...", "The role of the family in the environmental education of preschoolers." Together with her parents, she organized exhibitions: "Gifts of Autumn", "Mother's hands do not know boredom!", "Christmas tree - a prickly needle", "Santa Claus's workshop". As a result, the families of my pupils have become more active and competent in the development of the moral qualities of children.

The development of the scientific and creative potential of pupils made it possible to take part in competitions:

Allow me to present to your attention the results of my professional activities, based on the following legal documents, which are presented on the slide.

Based on the Federal standards, it is necessary to highlight that one of the main tasks of the Federal State Educational Standard is: “combining training and education into a holistic educational process based on spiritual, moral and sociocultural values ​​and rules adopted in society, and norms of behavior in the interests of a person, family, society ". Thus, it is important to recognize that moral and patriotic education is one of the most important links in the system of educational work in preschool educational institutions.

During the inter-certification period, I monitored preschoolers at the beginning and at the end of the school year. An analysis of the results of pedagogical research at this stage showed that in all educational areas, both at the beginning and at the end of the year, the average and low levels mainly prevail.

Work in this direction began with the creation of a warm, cozy atmosphere for children. Every day a child in kindergarten should be filled with joy, smiles, good friends, and fun games. In the process of work, she enriched the developing subject-spatial environment in the direction of developing the moral qualities of the personality of each child. I use modern educational technologies productively.

The application of the project technology made it possible to integrate educational areas and involve parents as much as possible in the activities of children, to establish close partnerships between all participants in the educational process. Relatively recently, I got acquainted with the innovative Lepbook gaming technology, studied and implemented it in my activities.

The result of work in this area is the positive dynamics of the development of the educational program by children in all five areas.
